Abstract

Perkembangan teknologi informasi yang semakin cepat telah mempengaruhi banyak aspek kehidupan, termasuk bidang kegiatan dikalangann profesi kenotariaran. Lebih dari itu, pandemi Covid 19 memaksa dan mengharuskan aktifitas dilakukan dari rumah dengan memanfaatkan teknologi informasi. Menghadapi perubahan seperti itu, para Notaris ternyata belum siap untuk beralih dan memanfaatkan teknologi informasi dalam pembuatan akta, khususnya surat wasiat yang banyak dibutuhkan masyarakat. Penelitian ini bertujuan mengkaji ketersediaan aturan dan melakukan evaluasi regulasi serta menyusun rekomendasi pemecahan masalah terkait pembuatan surat wasiat melalui sistem teknologi informasi ditengah masa pandemi Covid 19. Jenis penelitian yang digunakan yuridis empiris. Bahan hukumnya diperoleh dengan mengumpulkan data kepustakaan dan wawancara kepada perwakilan profesi notaris/PPAT. Hasil penelitian menyimpulkan bahwa pembuatan surat wasiat yang dibuat melalui sistem teknologi informasi belum memiliki landasan pengaturan yang jelas, baik dari segi substansi maupun aspek legalitasnya. Konsekuensinya, dokumen akta notaris, termasuk surat wasiat yang dibuat melalui sistem teknologi informasi belum dapat dijadikan akta otentik yang memiliki kekuatan pembuktian sempurna./The development of technology has affected many aspects in life, including the activity among notary. More than that, pandemic Covid-19 forces and requires activities should be done from home by maximizing technology. Facing such changes, notaries are not ready to switch and utilize technology in making deeds, especially testaments which are needed by the society by now. This study aims to examine the availability of rules and evaluate regulations as well as finding recommendations to solve problems related to the making of testaments through the technology in the midst of the pandemic Covid 19. Using empiric juridical research, the legal material is obtained by collecting data library and interviews with representatives of the notary/PPAT. The results of the study concluded that the making of testaments through information technology system did not have the rights, both in terms of substance and legal aspects. Consequently, notarial deed documents, including wills made through the technology can not be stated as the authentic deeds that have the perfect proof of evidence.
