Abstract

A notary is a public official appointed by the Government to help the people (natural and legal person) make current agreements or agreements that appear in the community. The purpose of making this written agreement before a Notary is to guarantee the legal certainty of the stakeholders of the agreement. A written agreement made before a Notary is called a Deed. A notary can be held criminally liable against the Deed made by him based on what he saw, witnessed and experienced in a legal action if, intentionally or negligently, the Notary made a fake deed that harmed the other party and fulfilled the elements in Article 266 paragraph (1) juncto Article 55 paragraph (1) of the Criminal Code. This study aims to determine the role of the Indonesia Notary Association (INI) to supervise the Notaries in carrying out their duties and positions. Indonesian Notary Association (INI) as the only Notary organization certainly has an important role in the field of supervision. The proper supervision from the Indonesian Notary Association (INI) is required not only to impose warning but also necessary to have strict sanctions to give deterrent effect for the violating Notary, hence to prevent recurring mistakes and to maintain the good name of the Notary. / Notaris adalah pejabat publik yang ditunjuk oleh Pemerintah untuk membantu masyarakat membuat perjanjian saat ini atau yang muncul di masyarakat. Tujuan pembuatan perjanjian tertulis ini di hadapan Notaris adalah untuk menjamin kepastian hukum pemangku kepentingan perjanjian. Perjanjian tertulis yang dibuat di hadapan Notaris adalah disebut Akta. Notaris dapat dimintai pertanggungjawaban pidana terhadap akta yang dibuat olehnya berdasarkan apa yang dilihat, disaksikan, dan dialaminya dalam suatu perbuatan hukum jika secara sengaja atau lalai, notaris membuat akta palsu sehingga merugikan pihak lain serta memenuhi unsur dalam Pasal Pasal 266 ayat (1) juncto Pasal 55 ayat (1) KUHP. Penelitian ini bertujuan untuk mengetahui peran Ikatan Notaris Indonesia (INI) dalam pengawasan Notaris dalam pelaksanaan tugas dan jabatannya. Ikatan Notaris Indonesia (INI) sebagai satu - satunya organisasi Notaris tentu memiliki peran penting dalam bidang pengawasan. Dibutuhkan pengawasan yang tepat dari Ikatan Notaris Indonesia (INI) dimana selain teguran juga diperlukan sanksi tegas yang bisa diberikan efek jera bagi Notaris yang melanggar, agar tidak terjadi lagi kesalahan yang sama dan nama baik notaris dipertahankan.
