Abstract

Tesis ini membahas mengenai cacat hukum pada surat kuasa mutlak dalam bentuk akta notariil. Hasil penelitian di lapangan pada saat ini masih banyak yang menggunakan kuasa mutlak dalam berbagaihal salah satunya kuasa mutlak digunakan dalam proses pemindahan hak atas tanah, dimana dalam beberapa aturan yang antara lain dalam Kitab Undang-undang Hukum Perdata dan PP Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah jelas tertulis terkait larangan menggunakan kuasa multak. Penelitian ini mengambil rumusan masalah mengenai cacat hukum pada surat kuasa notarial, kemudian perlaksaan dan praktek pemberian kuasa dalam akta notariil serta apa yang menjadi akibat hukum terhadap proses pengalihan hak atas tanah yang dibuat berdasarkan kuasa dalam bentuk akta notariil. Penggunaan kuasa mutlak jelas dilarang oleh Undang-undang maka dari itu kuasa mutlak ini dapat dikatakan cacat hukum, akan tetapi pada pelaksaannya kuasa mutlak masih digunakan salah satunya untuk perpindahan hak atas tanah dimana kuasa mutlak tersebut dibuat oleh notaris dalam bentuk akta notariil hal ini dapat diterima dikarenakan adanya perjanjian pendahulu sebagai dasar dari kuasa mutlak tersebut, maka kuasa mutlak yang tertuang dalam akta notariil tidak menjadi batal atau cacat hukum/This thesis discusses the legal defects in absolute power of attorney in the form of a notarial deed. The results of research in the field at this time are still many who use absolute power in various ways, one of which is absolute power used in the process of transferring land rights, where in several regulations, among others, in the Civil Code and Government Regulation Number 24 of 1997 concerning Land Registration. clearly written regarding the prohibition of using absolute power. This study takes the formulation of the problem regarding legal defects in a notarial power of attorney, then the implementation and practice of granting power in a notarial deed and what are the legal consequences of the process of transferring land rights based on a power of attorney in the form of a notarial deed.
