Abstract

Salah satu sengketa pertanahan yang terjadi di Indonesia adalah pemindahan hak atas tanah. Transaksi pembelian tanah yang bersifat tunai, terang dan riil wajib direalisasikan melalui penandatanganan akta jual beli (AJB) di hadapan pejabat pembuat akta tanah (PPAT). Apabila calon pembeli bermaksud hanya membeli suatu bagian dari total tanah yang tercantum dalam sertifikat, maka sertifikat tersebut harus dipecah terlebih dahulu menjadi bagian tanah-bagian tanah sebelum para pihak menandatangani AJB. Sehubungan dengan penjualan tanah untuk pembangunan perumahan, pemilik tanah yang memiliki perjanjian kerjasama dengan pihak developer dalam penjualan tanah-tanah tersebut, dapat memberi kuasa untuk menjual kepada pihak developer. Kuasa ini diberikan untuk mendukung kerjasama diantara pemilik tanah dan developer. Selanjutnya, apabila terdapat suatu ketidaksepahaman antara pemilik tanah dan penerima kuasa mengenai kerjasama atas penjualan tanah tersebut, maka terdapat kemungkinan pemilik tanah mencabut surat kuasa tersebut. Dalam hal ini, notaris/PPAT yang membantu pihak developer untuk melakukan pemecahan sertifikat hak atas tanah, atas dasar kuasa yang telah dicabut, dimungkinkan untuk dikenakan sanksi secara perdata, pidana, dan administratif./ One of the land disputes that occurs in Indonesia is the transfer of land rights. Cash, clear and real land purchase transactions must be realized through the signing of a sale and purchase deed (AJB) before the land deed officer (PPAT). If the prospective buyer intends to buy only a part of the total land stated in the certificate, such certificate needs to be subdivided into lots before the parties sign the AJB. In connection with the sale of land for the housing development, the land owner who has a cooperation agreement with the developer for the sale of these divided lands, can grant a power of attorney to sell to the developer. The granting of this power of attorney is principally made to support cooperation between land owners and developers. Furthermore, if there is a disagreement between the land owner and the attorney regarding the process of selling the land, there is possibility that the land owner may revoke the power of attorney. In this case, a notary/PPAT who participates in or assist the developer in carrying out land subdividing on the basis of the revoked power of attorney, may be subject to civil, criminal, and administrative sanctions.
