Abstract

Notaris merupakan pejabat umum yang berwenang dalam membuat akta autentik, hal tersebut didasari dengan ketentuan dalam Pasal 1 ayat 1 Undang-undang Nomor 2 tahun 2014 tentang Perubahan atas Undang-undang Nomor 30 tahun 2004 Tentang Jabatan Notaris, yang pada prinsipnya Notaris mempunyai kewenangan tertentu, artinya setiap wewenang yang diberikan pada jabatan harus ada aturan hukumnya sebagai batasan agar jabatan dapat berjalan dengan baik, dan tidak menimbulkan kekeliruan serta tidak bertabrakan dengan wewenang lainnya. Dalam hal Notaris menerima titipan Sertipikat oleh penghadap, hal tersebut pada dasarnya bukan merupakan tindakan yang dilarang dalam peraturan jabatan Notaris, sekalipun wajar dilakukan dalam memenuhi syarat administrasi. Dengan begitu kepastian hukum terhadap aturan yang mengatur hal tersebut sangat diperlukan, karena jika pada akhirnya Notaris harus melakukan hal tersebut maka secara tidak langsung memiliki kewajiban dan resiko yang lebih besar karena terikat pada ketentuan mengenai penitipan dalam Kitab Undang-Undang Hukum Perdata (KUHPer). Yaitu berdasarkan pada Pasal 1706 KUHPer, Serta dampak lain dan sanksi yang dapat diberikan kepada Notaris. Permasalahan yang akan dibahas dalam tesis ini adalah bagaimana wewenang dan tanggung jawab seorang Notaris dalam hal menerima penitipan Sertipikat oleh penghadap khususnya dalam peraturan yang mengatur jabatan Notaris, serta jaminan hukum terhadap Notaris yang melakukan hal tersebut. Untuk menjawab permasalahan tersebut maka dilakukan penelitian secara Normatif, yaitu menggunakan data sekunder dilengkapi bahan hukum Primer, Sekunder, dan Tersier lalu dianalisis data secara kualitatif serta penarikan kesimpulan dengan menggunakan metode deduktif. Hasil penelitian menjelaskan bagaimana wewenang dan tanggung jawab seorang Notaris dalam menerima penitipan Sertipikat di tinjau dari Peraturan Jabatan Notaris serta menjelaskan jaminan hukum terhadap Notaris yang melakukan tindakan tersebut berdasarkan Peraturan lainnya / Notaries are public officials authorized to do authentic deeds, and it is based on the provisions in Article 1 paragraph 1 of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Positions, which in principle, Notaries have a certain authority. It means that every authority given to the position must have a legal rule as a limit so that the position can run well and not cause errors, and not collide with other authorities. Suppose a Notary receives a certificate deposited by the appearer. In that case, this is not an action prohibited in the Notary position regulations, although it is reasonable to fulfill administrative requirements. Thus, legal certainty regarding the rules governing this matter is very necessary. After all, if, in the end, a Notary has to do this, it will indirectly have greater obligations and risks because it is bound by the provisions regarding deposits in the Civil Code (KUHPer). It is based on Article 1706 of the Civil Code and other impacts and sanctions that can be given to a Notary. The research questions: how does the authority and responsibility of a Notary receive a certificate deposit by an appearer, especially in the regulations governing the position of a Notary, and legal guarantees. The researcher was conducted normative research by using secondary data equipped with Primary, Secondary, and Tertiary legal materials, then analyzed the data qualitatively and concluding using the deductive method. The study results explain how the authority and responsibility of a Notary in receiving a certificate deposit are reviewed from the Notary Position Regulations and explain the legal guarantees for a Notary who takes such action based on other Regulations.
