Abstract

Pengadaan Tanah Bagi Kepentingan Umum, dimaksudkan untuk menjamin tersedianya bidang-bidang tanah untuk berbagai keperluan pembangunan, salah satunya adalah pembangunan jalan tol. Hal ini sering menimbulkan permasalahan hukum, sehingga mendorong penulis untuk melakukan penelitian. Pokok permasalahannya adalah bagaimana penerapan prinsip keadilan dalam pemberian ganti kerugian atas kepemilikan tanah dalam pengadaan tanah bagi pembangunan jalan tol Batang-Semarang (ruas Kendal), bagaimana penerapan prinsip keadilan dalam Putusan Mahkamah Agung Republik Indonesia nomor 1851 K/PDT/2017. Tipe penelitian yang dipilih adalah yuridis normatif dengan sifat deskriptif analisis dan jenis data yang digunakan adalah data sekunder. Hasil penelitian dianalisis secara kualitatif untuk selanjutnya ditarik kesimpulan secara deduktif, pelaksanaan pengadaan tanah dan pemberian kerugian untuk pembangunan jalan Tol Batang-Semarang(ruas Kendal) telah sesuai dengan Undang-Undang Nomor 2 Tahun 2012 yaitu dalam proses pengadaan Tanah dan pemberian ganti kerugian yang layak dan adil kepada pihak yang berhak, kendala-kendala yang dihadapi adalah perubahan penguasaan lahan secara tidak sah dan Pola Fikir Masyarakat yang keliru mengenai Besaran Ganti Rugi dan upaya penyelesaiannya adalah melakukan konsinyasi dan penetapan ganti kerugian berdasarkan hasil tim penilai dengan memperhitungkan nilai fisik dan nilai non fisik tanah / Land Procurement for Public Interest is intended to ensure the availability of land parcels for various development purposes, one of which is the construction of toll roads. This often causes legal problems, thus encouraging the author to conduct research. The main problem is how is the application of the principle of justice in providing compensation for land ownership in land acquisition for the construction of the Batang-Semarang toll road (Kendal section), how is the application of the principle of justice in the Decision of the Supreme Court of the Republic Indonesia number 1851 K/PDT/2017. The type of research chosen is normative juridical with descriptive analysis and the type of data used is secondary data. The results of the study were analyzed qualitatively and then concluded deductively, the implementation of land acquisition and the provision of losses for the construction of the Batang-Semarang Toll Road (Kendal section) was in accordance with Law No. 2 of 2012 namely in the process of land acquisition and the provision of appropriate compensation and fair to the parties, the obstacles faced are illegal changes in land tenure and the wrong mindset of the community regarding the amount of compensation and the solution is to carry out consignment and determine compensation based on the results of the assessment team taking into account the value physical and non-physical value of the land.
