Abstract

Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria diberlakukan agar Warga Negara Indonesia (selanjutnya disingkat “WNI”) dapat melaksanakan hak-haknya secara aman, menyediakan jaminan dan perlindungan hukum dalam bidang pertanahan, serta untuk menghapuskan dualisme perundangan dalam bidang pertanahan dan memberikan kepastian hukum bagi WNI. Dengan diberlakukannya undang-undang tersebut, Hak Milik atas tanah di Indonesia hanya dapat dimiliki oleh WNI. Namun pada kenyataannya, tidak sedikit Warga Negara Asing (selanjutnya disingkat “WNA”) yang tertarik untuk memiliki tanah di Indonesia, baik untuk dijadikan tempat tinggal maupun berusaha. Untuk mengakali undang-undang yang tidak mengijinkan WNA memiliki tanah, timbullah penggunaan perjanjian nominee di mana WNI meminjamkan namanya untuk digunakan oleh WNA di Sertifikat Hak Milik, dengan kepemilikan penuh tetap menjadi milik WNA. Dengan demikian, WNA memiliki tanah di Indonesia, dan secara hukum nama tersebut tetap atas nama WNI. Hal ini pada hakikatnya merugikan bangsa Indonesia, sehingga para pihak yang terlibat harus diberi konsekuensi untuk menghindari terulangnya kejadian yang sama. Oleh karena itu, Penulis tertarik untuk meninjau permasalahan ini untuk mengetahui bagaimana perbuatan PPAT membuat Akta untuk transaksi jual beli tanah yang diselundupkan melalui perjanjian nominee sebagai suatu perbuatan melawan hukum dalam Putusan Mahkamah Agung Nomor 3200 K/Pdt/2014 dan bagaimana upaya pemerintah untuk menghindari terjadinya penyelundupan hukum lewat perjanjian nominee dalam jual beli tanah di Indonesia. Dalam melakukan penelitian ini, metode penelitian yang digunakan Penulis adalah penelitian kualitatif dengan jenis penelitian yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan, pendekatan kasus dan pendekatan konseptual. / Law Number 5 of 1960 regarding Basic Regulations on Agrarian Principles is enacted so that Indonesian citizens (hereinafter abbreviated as "WNI") can safely exercise their rights, to provide legal guarantees and protections in the land sector, as well as eliminate legal dualism and provide legal certainties for Indonesian citizens. With the enactment of this law, land ownership rights in Indonesia can only be owned by WNI. However, many foreign citizens (hereinafter abbreviated as “WNA”) remain interested in owning land in Indonesia, either for a place to stay or do business. To circumvent the law that prohibits WNA from owning land, nominee agreements where WNI lend their name to be used by WNA in their Land Ownership Certificates, with WNA retaining complete ownership are used. Thus, WNA own the land, while being legally registered under WNI. This is essentially detrimental to the Indonesian people, so the parties involved must be given consequences to avoid recurrences of this incident. Therefore, the author is interested in reviewing this problem to find out about Land Deed Official’s action of making a Land Sale and Purchase deed smuggled through a nominee agreement as a tort in the Supreme Court Decision Number 3200 K/Pdt/2014 and what the government's efforts are to avoid the occurrence of legal smuggling through nominee agreements in the sale and purchase of land in Indonesia. This research is conducted with a qualitative research method and is a normative juridical research, done through statutory, case and conceptual approaches.
