Abstract

Badan-badan internasional menyampaikan bahwa korporasi rentan digunakan oleh seseorang yang justru tidak terdata/tercatat sebagai legal owner. Mereka inilah yang disebut dengan pemilik manfaat sebenarnya dari korporasi atau yang dikenal dengan Beneficiary Ownership. Pemerintah mengeluarkan Peraturan Presiden No. 13 Tahun 2018 tentang Penerapan Prinsip Mengenali Pemilik Manfaat dari Korporasi Dakam Rangka Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang dan Tindak Pidana Pendanaan Terorisme. Penentuan pemilik manfaat sebenarnya dari korporasi didasarkan pada seseorang menerima 25% Sisa Hasil Usaha, seseorang mempunyai kewenangan untuk menentukan kepengurusan, seseorang berkuasa mengendalikan koperasi, seseorang menerima manfaat dan seseorang pemilik sebenarnya atas dana dari modal koperasi. Koperasi sebagai badan usaha yang berdasarkan atas asas kekeluargaan dan gotong royong, tidak dapat menyesuaikan dengan kriteria tersebut karena bertentangan dengan prinsip-prinsip koperasi sebagaimana ketentuan Undang-Undang No. 25 Tahun 1992 tentang Perkoperasian. Ketidakselarasan pengaturan tersebut menimbulkan ketidakpastian hukum bagi koperasi dan kemanfaatan dari pengaturan tersebut tidak dirasakan oleh koperasi. Metode penelitian yang di lakukan adalah penelitian hukum normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka berupa peraturan perundang-undangan dan buku-buku atau data sekunder terkait dengan pemilik manfaat sebenarnya dari koperasi. Secara teoretis penelitian ini akan memperkokoh dasar-dasar pemikiran mengenai sejauh mana pengaturan pemilik manfaat (Beneficiary Owner) dapat di terapkan oleh koperasi dan secara praktis penelitian ini akan memberikan masukan kepada pemerintah, Dinas Koperasi dan Ukm, gerakan koperasi dan pihak terkait lainnya terutama dari aspek organisasi, pengawasan dan sanksi terhadap koperasi yang di gunakan sebagai alat pencucian uang maupun pendanaan terorisme. Kedua ketentuan itu tidak konsisten karena penerapan kriteria dalam mengenali pemilik manfaat pada koperasi bertentangan dengan prinsip-prinsip koperasi sebagaimana ketentuan Undang-Undang Perkoperasian. / International agencies say that corporations are vulnerable to being used by someone who is not actually registered as a legal owner. They are called the true beneficial owners of the corporation or known as Beneficiary Ownership. The government issued Presidential Regulation No. 13 of 2018 concerning the Application of the Principle of Recognizing the Beneficial Owner of a Dakam Corporation for the Prevention and Eradication of the Crime of Money Laundering and the Financing of Terrorism. Determination of the actual beneficial owner of the corporation is based on someone receiving 25% of the remaining operating results, someone has the authority to determine the management, someone has the power to control the cooperative, someone receives benefits and someone is the real owner of the funds from the cooperative's capital. Cooperatives as business entities based on the principles of kinship and mutual cooperation, cannot conform to these criteria because they are contrary to cooperative principles as stipulated in Law no. 25 of 1992 concerning Cooperatives. The misalignment of these arrangements creates legal uncertainty for cooperatives and the benefits of these arrangements are not felt by cooperatives. The research method used is normative legal research, namely legal research conducted by examining library materials in the form of legislation and books or secondary data related to the actual beneficial owners of the cooperative. Theoretically this research will strengthen the basics of thinking about the extent to which beneficial owner arrangements can be applied by cooperatives and practically this research will provide input to the government, the Cooperatives and SMEs Office, the cooperative movement and other related parties, especially from the aspect of organization, supervision and sanctions against cooperatives that are used as a means of money laundering and terrorism financing. The two provisions are inconsistent because the application of criteria to identify beneficial owners in cooperatives is contrary to cooperative principles as stipulated in the Cooperative Law.
