Abstract

Pemilihan Umum merupakan hal yang penting bagi Indonesia. Tujuan Pemilihan Umum adalah untuk mencari pemimpin pemerintahn yang punya kompetensi dan kemampuan baik dalam mengambil kebijakan publik, saat ini pelaksanaan pemilihan umum banyak dipengaruhi oleh keberadaan praktik politik uang.Tujuan penulisan ini adalah untuk mengetahui tentang faktor dan dampak dari praktik tersebut terhadap pemilihan umum, serta penegakan hukum terhadap tindak pidana money yang selalu terjadi dalam pelaksanaan pemilihan umum. Jenis penelitian dalam penulisan skripsi ini adalah penelitian deskriptif kualitatif dengan metode ex post facto, yaitu pengambilan data lapangan dengan menggambarkan secara lengkap dan jelas tentang penegakan hukum ditinjau menggunakan UU Nomor 7 Tahun 2017 tentang pemilihan umum serta menganalisa putusan tindak pidana money politic yang sudah berkekuatan hukum tetap. Hasil penelitian menujukkan bahwa penegakan hukum terhadap tindak pidana money politic tidak dapat memberikan efek jera, hal ini terlihat berdasarkan beberapa keadaan dan fakta yang Penulis temukan dalam pelaksanaan penelitian ini, antara lain hukuman yang diberikan dikategorikan sebagai hukuman ringan, hal ini dikarenakan putusan atau sanksi yang mengancam pelaku tindak pidana politik uang hanya 1 tahun 15 hari penjara, hukuman ini tidak memberikan efek jera dan tidak sesuai dengan tujuan dari teori pemidanaan yakni memberikan efek jera, baik kepada masyarakat secara umum sebagai bentuk pencegahan ataupun kepada pelaku agar tidak mengulangi perbuatan tersebut. Penegakan hukum terhadap tindak pidana money politic dalam pelaksanaan pemilihan umum perlu ditingkatkan agar dapat menjamin adanya pelaksanaan pemilihan umum yang sesuai dengan asas dan tujuan pelaksanaan pemilihan umum berdasarkan UU Nomor 7 Tahun 2017 tentang Pemilihan Umum./General Election is an important thing for Indonesia. The purpose of the General Election is to find government leaders who have good competence and abilities in making public policies. Currently, the implementation of general elections is largely influenced by the existence of money politics practices.The purpose of this paper is to find out about the factors and impacts of these practices on general elections, as well as law enforcement against money crimes that always occur in general elections. This thesis` research method is a qualitative descriptive study with the ex post facto method, namely taking field data by describing completely and clearly about law enforcement reviewed using Law Number 7 of 2017 concerning general elections and analyzing decisions on money political crimes that are legally binding. permanent. The results of the study show that law enforcement against money political crimes cannot provide a deterrent effect, this can be seen based on several circumstances and facts that the author found in the implementation of this study, including the punishment given is categorized as light punishment, this is due to the verdict or sanction threatening the perpetrators of money politics crimes for only 1 year 15 days in prison, this punishment does not provide a deterrent effect and is not in accordance with the objectives of the theory of punishment, which is to provide a deterrent effect, both to the public in general as a form of prevention or to the perpetrator not to repeat the act. Law enforcement against money political crimes in the implementation of general elections needs to be improved in order to guarantee the implementation of general elections in accordance with the principles and objectives of the implementation of general elections based on Law Number 7 of 2017 concerning General Elections.
