Abstract

Tujuan penelitian ini adalah memberitahukan bahwa di Indonesia sebagai Negara yang menjamin kepastian hukum akan kepemilikan tanah yang sah dan dapat dipertanggung jawabkan melalui badan atau lembaga yang ditunjuk. Hal ini tertuang dari munculnya perundang-undangan yakni Undang - Undang Nomor 5 tahun 1960 tentang Peraturan Dasar Pokok - Pokok Agraria. Namun dengan adanya perkembangan zaman yang terus memasuki era revolusi industri 5.0, Indonesia berupaya memberikan perbaikan dari dunia analog menuju dan serta mengintegrasikan ke dunia online atau digital. Maka dari itu, dalam tesis ini membahas mengenai Proses Penerbitan Sertipikat Tanah Secara Elektronik setelah berlakunya Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Republik Indonesia Nomor 1 Tahun 2021 tentang Sertipikat Elektronik dan Kekuatan Pembuktian Sertipikat Elektronik untuk Jaminan Kepastian Hukum dibidang Pertanahan, terkait tulisan diatas metode yang digunakan ialah yuridis normatif, 2 hal tersebut bisa dikatakan sebagai salah satu revolusi industri 5.0 yang sedang dijalankan negara atau Indonesia. / The purpose of this research is to inform that in Indonesia as a country that guarantees legal certainty of legal and accountable land ownership through a designated agency or institution. This is stated in the emergence of legislation, namely Law Number 5 of 1960 concerning Basic Agrarian Regulations. However, with the development of the times that continue to enter the era of the 5.0 industrial revolution, Indonesia seeks to provide improvements from the analog world to and and integrates into the online or digital world. Therefore, in this thesis discusses about the Electronic Land Certificate Issuance Process after the enactment of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 1 of 2021 concerning Electronic Certificates and the Power of Evidence of Electronic Certificates for Legal Certainty Guarantees in the Land sector, related In the article above, the method used is normative juridical, these 2 things can be said as one of the 5.0 industrial revolutions that are being carried out by the state or Indonesia.
