Abstract

Tujuan Penelitian ini adalah mengetahui upaya pemerintah dalam menanggulangi peredaran makanan kadaluwarsa mengetahui sanksi bagi pelaku pengedaran atau penjual makanan kadaluwarsa serta mengetahui perlindungan hukum bagi konsumen terhadap peredaran makanan kadaluwarsa. Metode penelitian hukum yang digunakan dalam penelitian ini adalah penelitian yuridis empiris yang merupakan penelitian hukum mengenai pemberlakuan atau implementasi ketentuan hukum normatif pada setiap peristiwa hukum tertentu yang terjadi dalam masyarakat. Penelitian yuridis empiris merupakan penelitian lapangan (penelitian terhadap data primer) yaitu suatu penelitian meneliti peraturan-peraturan hukum yang kemudian digabungkan dengan data dan prilaku hidup ditengah-tengah masyarakat. Data dalam penelitian ini diperoleh secara langsung melalui wawancara. Hasil dari penelitian ini adalah upaya pemerintah dalam menanggulangi peredaran makanan kadaluwarsa dilakukan dengan pengawasan yang dilakukan melalui BPOM, Sanksi bagi pelaku pengedaran atau penjual makanan kadaluwarsa berbentuk sanksi administratif, sanksi pidana dan sanksi perdata. Perlindungan hukum bagi konsumen atas peredaran makanan kadaluwarsa diatur didalam Undang-Undang Perlindungan Konsumen dan Undang-Undang Tentang Pangan. Konsumen yang menderita akibat produk pangan kadaluwarsa akan mendapat perlindungan hukum secara preventif dan represif. Perlindungan preventif yaitu berupa penyuluhan dan pembinaan oleh pihak BPOM kepada konsumen agar cermat dalam memilih produk yang akan dibeli atau dikonsumsi untuk menghindari kerugian-kerugian yang dapat dialami oleh konsumen. Perlindungan represif yaitu konsumen harus mendapat pertanggungjawaban dari pihak pelaku usaha atas kerugian yang dialami konsumen setelah mengonsumsi makanan yang telah kadaluwarsa, pelaku usaha wajib merawat dan memulihkan kesehatan konsumen sampai sembuh total, serta pelaku usaha wajib memeberikan santunan atau biaya hidup selama masa perawatan atau penyembuhan atas diri konsumen yang dirugikan. Jika pelaku tidak mau bertanggungjawab terhadap konsumen atas kerugian yang dialami, konsumen dapat segera melaporkan kepada BPSK di kota terdekat. Penyelesaian sengketa konsumen dapat dilakukan dengan cara litigasi dan non litigasi. Pemerintah diharapkan melakukan sosialisai tentang perlindungan hukum konsumen terkait makanan kadaluwarsa hal ini penting untuk meningkatkan kesadaran hukum masyarakat tentang hak-hak nya sebagai konsumen./ The purpose of this study was to determine the government's efforts in tackling the circulation of expired food, to know the sanctions for perpetrators of distribution or sellers of expired food and to know the legal protection for consumers against the circulation of expired food. The legal research method used in this research is empirical juridical research which is legal research regarding the enforcement or implementation of normative legal provisions in every particular legal event that occurs in society. Empirical juridical research is a field research (research on primary data) which is a study that examines legal regulations which are then combined with data and living behavior in the midst of society. The data in this study were obtained directly through interviews. The results of this study are the government's efforts in tackling the circulation of expired food carried out with supervision carried out through BPOM, Sanctions for distributors or sellers of expired food in the form of administrative sanctions, criminal sanctions and civil sanctions. Legal protection for consumers on the circulation of expired food is regulated in the Consumer Protection Act and the Law on Food. Consumers who suffer from expired food products will receive preventive and repressive legal protection. Preventive protection is in the form of counseling and guidance by BPOM to consumers to be careful in choosing products to be purchased or consumed to avoid losses that can be experienced by consumers. Repressive protection, namely consumers must receive accountability from business actors for losses suffered by consumers after consuming expired food, business actors are required to treat and restore consumer health until they are fully recovered, and business actors are required to provide compensation or living expenses during the treatment or recovery period. Consumers who are harmed. If the perpetrator does not want to be responsible for the consumer for the loss suffered, the consumer can immediately report to the BPSK in the nearest city. Settlement of consumer disputes can be done by litigation and non-litigation. The government is expected to conduct socialization on consumer legal protection related to expired food, this is important to increase public legal awareness about their rights as consumers.
