Abstract

Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap konsumen yang menerima barang yang tidak sesuai dengan pesanan. Tujuan kedua yaitu untuk mengetahui sanksi yang dapat diberikan kepada pihak penjual yang mengirim barang yang tidak sesuai pesanan. Selain itu penelitan ini bermanfaat memberikan wawasan baru dalam ilmu hukum khususnya Hukum Bisnis yang mencakup Hukum Perjanjian dan Hukum Perlindungan Konsumen, mengenai transaksi Jual – beli online dan memperkaya penelitian mengenai Transaksi jual - beli online. Metode penelitian hukum yang digunakan dalam penelitian ini adalah penelitian yuridis normatif yang merupakan penelitian yang dilakukan atau di tujukan hanya pada peraturan-peraturan yang tertulis dengan sifat penelitian deskriptif analisis yang merupakan suatu metode yang berfungsi untuk mendeskripsikan atau memberi gambaran terhadap objek yang diteliti melalui data atau sampel dan membuat kesimpulan yang berlaku untuk umum. Sumber data yang digunakan dalam penelitian ini adalah data primer dan sekunder dan analisis data kualitatif yang merupakan pengamatan fenomena yang di peroleh dari data-data yang di peroleh. Hasil Penelitian ini adalah Perlindungan hukum terhadap kosumen yang menerima barang yang tidak sesuai pesanan diatur didalam UU ITE dan UUPK. UU ITE sendiri memberikan perlindungan hukum terhadap konsumen dari segi penggunaan media elektronik e-commerce dalam transaksi jual beli online. sedangkan UUPK dalam rangka memberikan Perlindungan hukum didalam jual beli online mengatur tentang kewajiban pelaku usaha dalam memberikan hak konsumen salah satunya yaitu hak konsumen untuk menerima barang sesuai pesanan. Sanksi yang dapat diberikan kepada pihak penjual yang mengirim barang yang tidak sesuai pesanan dapat berupa sanksi perdata dalam bentuk pemberian ganti rugi ataupun pemberian kompensasi terhadap konsumen atau pembeli akibat barang yang diterima tidak sesuai pesanan atau pun dapat berupa unsur pidana apabila barang yang diterima tidak sesuai pesanan terdapat unsur tindak pidana seperti penipuan ataupun informasi yang menyesatkan selain itu pihak pemilik aplikasi ataupun pemilik toko jual beli online juga dapat dikenakan sanksi administratif mulai dari teguran hingga pencabutan izin./This study aims to determine the legal protection of consumers who receive goods that are not in accordance with the order. The second goal is to find out the sanctions that can be given to the seller who sends goods that do not match the order. In addition, this research is useful in providing new insights in legal science, especially Business Law which includes Agreement Law and Consumer Protection Law, regarding online buying and selling transactions and enrich research on online buying and selling transactions. The legal research method used in this research is normative juridical research which is research carried out or aimed only at written regulations with the nature of descriptive analysis research which is a method that functions to describe or provide an overview of the object under study through data or data sample and draw conclusions that apply to the general public. Sources of data used in this study are primary and secondary data and qualitative data analysis which is the observation of phenomena obtained from the data obtained. The results of this study are legal protection for consumers who receive goods that are not in accordance with the order regulated in the ITE Law and UUPK. The ITE Law itself provides legal protection for consumers in terms of the use of e-commerce electronic media in online buying and selling transactions. While the UUPK in order to provide legal protection in online buying and selling regulates the obligations of business actors in providing consumer rights, one of which is the right of consumers to receive goods according to orders. Sanctions that can be given to the seller who sends goods that are not in accordance with the order can be in the form of civil sanctions in the form of compensation or compensation to consumers or buyers due to goods received not according to the order or can be in the form of a criminal element if the goods received are not in accordance with the order there are elements of criminal acts such as fraud or misleading information, besides that the owner of the application or the owner of the online buying and selling shop can also be subject to administrative sanctions ranging from warnings to revocation of permits.
