Abstract

Telemedis merupakan suatu layanan kesehatan antara dokter atau praktisi kesehatan dengan pasien jarak jauh guna mengirimkan data medik pasien melalui komunikasi audio visual dengan mengunakan infrastruktur telekomunikasi yang sudah ada, seperti internet, satelit dan lain sebagainya. Tujuan”telemedis adalah”mengusahakan tercapainya”pelayanan kesehatan”secara”merata di seluruh populasi negara, meningkatkan kualitas pelayanan terutama untuk daerah terpencil”dan penghematan biaya dibandingkan cara”konvensional. Dasar Hukum Pelayanan Telemedis di Indonesia yang digunakan saat ini yaitu Peraturan Menteri Kesehatan Nomor 20 Tahun 2019 tentang Penyelenggaraan Pelayanan Telemedis Antar Fasilitas Pelayanan Kesehatan (Permenkes 20/2019). Untuk meninjau norma pengaturan tanggung jawab hukum rumah sakit terhadap layanan telemedis di Indonesia dan implementasi pelaksanaan transformasi pelayanan telemedis dari rumah sakit berdasarkan peraturan perundang- undangan di Indonesia diperlukan penelitian secara mendalam mengenai hal tersebut. Penelitian yang digunakan adalah penelitian yuridis normatif dan pengumpulan data dilakukan dengan pendekatan perundang-undangan, yaitu dengan menelaah berbagai norma pengaturan di bidang kesehatan dan meneliti implementasi pelaksanaan telemedis di rumah sakit. Dari hasil penelitian, dapat disimpulkan bahwa terkait dengan telemedis, perlu diadakan peraturan perundang-undangan yang khusus mengatur mengenai telemedis agar para penguna telemedis mempunyai payung hukum yang lebih memadai dalam menjalankan praktek telemedis kepada masyarakat. / Telemedicine is a health service between doctors or health practitioners and patients remotely to transmit patient medical data through audio-visual communication using existing telecommunications infrastructure, such as the internet, satellite and so on. The aim of telemedicine is to try to achieve health services that is evenly distributed throughout the population of the country, improve the quality of services, especially for remote areas and save costs compared to conventional methods. The legal basis for Telemedical Services in Indonesia currently used is the Minister of Health Regulation Number 20 of 2019 concerning the Implementation of Telemedical Services between Health Service Facilities (Permenkes 20/2019). To review the norms of hospital legal responsibility for telemedical services in Indonesia and the implementation of the transformation of hospital telemedicine services based on Indonesian laws and regulations, in-depth research is needed on this matter. The research used is normative juridical research and data collection is carried out with a statutory approach, namely by examining various regulatory norms in the health sector and examining the implementation of telemedicine in hospitals. From the results of the study, it can be concluded that related to telemedicine, it is necessary to enact legislation that specifically regulates telemedicine so that telemedicine users have a more adequate legal umbrella in carrying out telemedicine practices to the public.
