Abstract

Tujuan dari penelitian ini adalah untuk mengetahui keabsahan alasan pengusaha di dalam pengambilan keputusan PHK kepada pekerjanya pada masa pandemi Covid-19 sesuai Hukum Ketenagakerjaan dan bagaimana sebaiknya penyelesaian perselisihan PHK yang terjadi pada masa pandemi Covid-19 menurut Hukum Ketenagakerjaan. Jenis penelitian ini menggunakan penelitian hukum normatif yaitu mengkaji keabsahan alasan-alasan pengusaha dan proses penyelesaian perselisihan yang terbaik. Data yang digunakan adalah data sekunder, bersumber dari peraturan perundang-undangan, putusan MK dan MA serta teori atau pendapat para ahli. Metode pengumpulan data melalui studi kepustakaan dan internet, didukung oleh informasi yang diperoleh dari narasumber Hakim Pengadilan Hubungan Industrial pada Pengadilan Negeri Medan. Pendekatan penelitian undang-undang (statute approach) dan pendekatan konseptual (conceptual approach). Analisa data dilakukan secara kualitatif. Hasil penelitian, keabsahan hukum mengenai alasan pengusaha dalam melakukan PHK pada masa pandemi Covid-19 menurut UU Ketenagakerjaan sebelum dan setelah UU Cipta Kerja adalah efisiensi, perusahaan mengalami penurunan pendapatan/kerugian, dan juga perusahaan tutup total atau tutup sementara karena Peraturan Pemerintah atau keadaan memaksa (force majeure). Alasan PHK yang paling relevan digunakan pada masa pandemi Covid-19 adalah sebagaimana diatur dalam UU Cipta Kerja. Seluruh PHK dengan alasan tersebut harus disertai dengan pembayaran kompensasi hak-hak pekerja sesuai yang diatur dalam UU Ketenagakerjaan dan UU Cipta Kerja. Proses penyelesaian perselisihan PHK pada masa pandemi Covid-19 sebaiknya dilakukan secara non-litigasi melalui bipartit dan mediasi yang dapat menghasilkan win-win solution sebagaimana asas musyawarah untuk mufakat sebagaimana amanat sila ke-4 Pancasila. Tujuan hukum yakni kepastian hukum, kemanfaatan dan keadilan bagi pekerja yang di PHK dan bagi perusahaan dalam hal pembayaran kompensasi yang jumlahnya disepakati bersama dapat terwujud dalam penyelesaian bipartit dan mediasi./The purpose of this research is to find out the validity of the reasons for employers in making the decisions to do the termination of employment during the Covid-19 pandemic according to the Labor Law before and after the Omnibus Law and what is the best settlement of dispute over the termination of employment that occurred during the Covid-19 pandemic according to the Labor Law. This research is using a normative legal research method which examine the validity of the reasons for emloyers and the best settlement of dispute over the termination of employment. The data used are the secondary data, sourced from the legislation, the decisions of the Constitutional Court and the Supreme Court as well as theories or expert opinion. Method of data collection through literature study, internet studies, and supported by information obtain from a judge of Industrial Court at Medan District Court. Research approach using statute approach and conceptual approach. The data analysis was done qualitatively The result of this research, the validity of the reasons for employers in making the decisions to do the termination of employment during the Covid-19 pandemic according to the Labor Law before and after the Omnibus Law are efficiency, income decrease / loss, the company closed completely or temporarily due to government regulations (PSBB) or force majeure. The Omnibus Law is the only law that is relevant to use during the Covid-19 pandemic. All reasons of termination of employment must be included the compensation for workers as regulated in the Labor Law and the Omnibus Law. The best settlement of dispute over the termination of employment best done in a non-litigation manner through bipartite and mediation which will lead to a win-win solution as the principle of delibration for consensus as mandated by the 4th precept of Pancasila. The purpose of the law is to find legal certainty for both parties in terms of the compensation payment which amount is mutually agreed upon.
