Abstract

Penelitian ini bertujuan untuk mengetahui apa dampak dan manfaat suatu Corporate Social Responsibility (CSR) pada suatu perusahaan, bukan hanya kepada perusahaan tetapi juga kepada penerima bantuan CSR yaitu para masyarakat disekitar lingkungan perusahaan dan untuk mengetahui apa sebenarnya CSR itu dan mengapa harus dilaksanakan. Penelitian ini menggunakan metode penelitian yang bersifat normatif empiris yaitu pendekatan dengan cara membandingkan fakta yang ada di lapangan dengan teori-teori kepustakaan yang berkaitan dengan penelitian ini. Sumber data yang digunakan dalam penelitian ini adalah data primer berupa wawancara dan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data dalam penelitian ini dilakukan melalui studi pustaka baik dari buku maupun jurnal hukum yang berkaitan dengan permasalahan serta melakukan wawancara melalui pertanyaan yang terstruktur dan spontan dengan narasumber. Data yang telah penulis dapatkan akan dianalisis secara deskriptif kualitatif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian yang diperoleh dari penulisan ini antara lain bahwa Corporate Social Responsibity (CSR) merupakan kewajiban bagi para pelaku usaha/perusahaan yang ada melakukan kegiatan usaha dan berhubungan dengan Sumber Daya Alam pada lingkungan, sehingga program CSR merupakan suatu bentuk tanggung-jawab dari perusahaan. Pengaturan tentang CSR ini pun sudah jelas diatur dalam Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas. CSR dulunya hanya bersifat voluntary (sukarela) sekarang sudah menjadi bersifat mandatory (wajib). Pelaksanaan CSR ini pun memberikan manfaat bukan hanya kepada masyarakat melainkan juga kepada perusahaan. Bagi perusahaan yang tidak melaksanakan program CSR akan dikenakan sanksi sesuai yang diatur dalam Undang-Undang. Pelaksanaan CSR tidak lari dari konsep dasarnya yang dikenal dengan istilah “triple bottom line” atau 3P (Profit, People dan Planet) bila dikaitkan antara ketiganya dapat disimpulkan bahwa “profit” sebagai wujud aspek ekonomi, “people” sebagai aspek sosial dan “planet” sebagai wujud aspek lingkungan./ This study aims to determine what the impacts and benefits of a Corporate Social Responsibility (CSR) are on a company, not only to the company but also to the recipients of CSR assistance, namely the community around the company and to find out what CSR is and why it should be implemented. This study uses a normative empirical research method, namely an approach by comparing the facts in the field with the literature theories related to this research. Sources of data used in this study are primary data in the form of interviews and secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques in this study were carried out through literature studies from books and legal journals related to the problem as well as conducting interviews through structured and spontaneous questions with sources. The data that the author has obtained will be analyzed descriptively qualitatively to obtain answers to problems. The research results obtained from this paper include that Corporate Social Responsibility (CSR) is an obligation for business actors / companies that do business and relate to natural resources in the environment, so that the CSR program is a form of corporate responsibility. The regulation on CSR is also clearly regulated in Law No. 40 of 2007 concerning Limited Liability Companies. Previously, CSR was only voluntary, now it has become mandatory. This CSR implementation also provides benefits not only to the community but also to the company. Companies that do not implement CSR programs will be subject to sanctions in accordance with the law. The implementation of CSR does not run away from the basic concept known as "triple bottom line" or 3P (Profit, People and Planet). When linked between the three, it can be concluded that "profit" is a form of economic aspect, "people" is a social aspect and "planet" as a manifestation of environmental aspects.
