Abstract

Tujuan penelitian ini adalah untuk mengetahui dan menganalisa perlindungan hukum terhadap anak yang ikut dalam demo Undang-Undang Cipta Kerja menurut Hukum Pidana di Indonesia dan mengetahui implementasi penegakan hukum terhadap eksploitasi anak yang ikut demo Undang-Undang Cipta Kerja. Metode penelitian ini menggunakan jenis penelitian yang bersifat yuridis normatif dengan melakukan analisa terhadap norma hukum positif serta kehidupan sosial yang berkaitan dengan permasalahan. Metode pengumpulan data penelitian dilakukan melalui kepustakaan, atau peraturan perundang-undangan,media-media online serta kasus-kasus hukum yang memiliki kaitan dengan permasalahan. Jenis pendekatan penelitian yang digunakan ialah pendekatan terhadap kasus hukum adalah penelitian yang menganalisa data primer dan data sekunder. Data yang dikumpulkan oleh penulis akan dianalisis dengan menggunakan teknik analisis data deskriptif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian ini yang diperoleh adalah analisa kasus yang terjadi di lapangan, beberapa anak yang diberikan perintah kepada anak-anak agar mau turut mengakomodir teman-teman lainnya untuk mengikuti demonstrasi penolakan terhadap UU Omnibus Law. Eksploitasi anak yang ikut dalam demonstrasi penolakan sudah masuk dalam ranah hukum pidana yang dilindungi sesuai dengan UU Perlindungan Anak. Terkait dalam kasus anak yang ikut demonstrasi sudah mendapatkan perlindungan hukum yang sesuai seperti penindakan anak, pendatan dan tes kesehatan. Implementasi perlindungan hukum anak yang mengikuti demonstrasi memiliki 3 (tiga) aspek, yakni perlindungan, pencegahan, dan penanganan. Perlindungan hukum terhadap anak sudah diatur dalam peraturan perundangan seperti pada UU No.35 Tahun 2014, bahkan dibentuk Komisi Perlindungan Anak Indonesia (KPAI). Bagi pelaku tindak kejahatan eksploitasi anak dalam aksi demonstrasi akan diberikan sanksi yang diatur di Undang-Undang No.35 tahun 2014 tentang perlindungan anak yang berisi tentang “Setiap orang yang melakukan eksploitasi anak akan dipidana penjara paling lama 10 tahun dan/atau denda paling banyak Rp.200.000.000 (dua ratus juta rupiah)”. / The purpose of this research is to know and analyze the legal protection of children who participate in the demo of the Copyright Act according to Criminal Law in Indonesia and to know the implementation of law enforcement against child exploitation that participates in the demo of the Copyright Act. This research method uses a type of research that is juridical normative by analyzing positive legal norms and social life related to problems. Research data collection methods are conducted through literature, or legislation, online media and legal cases related to the problem. The type of research approach used is the approach to legal cases is research that analyzes primary data and secondary data. The data collected by the authors will be analyzed using descriptive data analysis techniques to obtain answers to problems. The results of this study obtained is an analysis of cases that occurred in the field, some children who were given orders to children to be willing to accommodate other friends to participate in demonstrations of rejection of the Omnibus Law. Child exploitation that participated in the demonstration of rejection has entered into the realm of criminal law that is protected in accordance with the Child Protection Law. Related in the case of children who participated in the demonstration has obtained appropriate legal protection such as child abuse, prosecution and health tests. The implementation of child protection that follows the demonstration has 3 (three) aspects, namely protection, prevention, and handling. Legal protection of children has been regulated in the legislation as in Law No.35 of 2014, even established by the Indonesian Child Protection Commission (KPAI). For perpetrators of child exploitation crimes in demonstrations will be given sanctions stipulated in Law No.35 of 2014 on child protection containing "Every person who commits child exploitation will be sentenced to a maximum of 10 years imprisonment and/or a maximum fine of Rp.200,000,000 (two hundred million rupiah)".
