Abstract

Penelitian ini bertujuan pertama untuk mengetahui bentuk perlindungan hukum terhadap penumpang ojek online berbasis aplikasi menurut Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor Yang Digunakan Untuk Kepentingan Masyarakat. Tujuan kedua untuk mengetahui implementasi perlindungan hukum terhadap penumpang ojek online berbasis aplikasi menurut Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor Yang Digunakan Untuk Kepentingan Masyarakat. Penelitian ini menggunakan metode penelitian hukum normatif empiris. Cara perolehan data adalah dengan data pustaka, didukung wawancara, dan melakukan kuesioner tertutup secara online. Penelitian hukum normatif empiris mengutamakan data sekunder yang dikuatkan dengan data primer berupa wawancara dengan narasumber sesuai dengan topik penelitian, dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap penumpang ojek online sudah sesuai dengan Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor Yang Digunakan Untuk Kepentingan Masyarakat khususnya pada pasal 4 -8 yang berisi aspek keselamatan, keamanan, kenyamanan, keterjangkauan, dan keteraturan dan pasal 16 ayat 2 berisi aspek keselamatan dan keamanan, kenyamanan, kepastian mendapatkan layanan, layanan pengaduan dan penyelesaian masalah penumpang, kepastian biaya jasa sesuai dengan kesepakatan yang tertera di aplikasi, dan kepastian mendapatkan santunan jika terjadi kecelakaan harus diterapkan. Implementasi perlindungan hukum terhadap penumpang ojek online sudah cukup memadai dan memenuhi aspek-aspek yang terdapat dalam Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor Yang Digunakan Untuk Kepentingan Masyarakat. Perusahaan gojek menyediakan fitur dan fasilitas guna menjamin keselamatan dan keamanan penumpang saat menggunakan ojek online. Dalam kenyataannya masih banyak ditemukan driver yang tidak memenuhi kebijakan dan peraturan yang diberikan oleh perusahaan Gojek sehingga perlindungan terhadap penumpang ojek online tidak sepenuhnya terlindungi. /This study aims to first find out the form of legal protection for online ojek passengers based on applications according to Regulation of the Minister of Transportation No. 12 of 2019 concerning the Protection of Motorcycle User Safety Used For Public Benefit. The second objective is to know the implementation of legal protection for online ojek passengers based on the application according to Regulation of the Minister of Transportation No. 12 of 2019 concerning the Protection of Motorcycle User Safety Used For Public Benefit. This research uses empirical normative legal research methods. The way data is obtained is with library data, supported interviews, and conducting closed questionnaires online. Empirical normative legal research prioritizes secondary data that is corroborated by primary data in the form of interviews with resource persons in accordance with research topics, and is analyzed qualitatively. The results showed that the legal protection of online ojek passengers is in accordance with Regulation of the Minister of Transportation No. 12 of 2019 concerning the Protection of Safety of Motorcycle Users Used for The Benefit of the Public, especially in article 4 -8 which contains aspects of safety, security, comfort, affordability, and regularity and article 16 paragraph 2 contains aspects of safety and security, comfort , certainty of obtaining services, complaints services and resolution of passenger problems, certainty of service costs in accordance with the agreement stated in the application, and certainty of obtaining compensation in the event of an accident must be applied. The implementation of legal protection for online ojek passengers is sufficient and meets the aspects contained in Regulation of the Minister of Transportation No. 12 of 2019 concerning the Protection of Motorcycle User Safety Used for Public Benefit. Gojek company provides features and facilities to ensure the safety and security of passengers when using online motorcycle taxis. In reality there are still many drivers who do not meet the policies and regulations provided by gojek company so that the protection of online ojek passengers is not fully protected.
