Abstract

Tujuan penelitian ini adalah untuk mengetahui dan menganalisis perlindungan hukum terhadap korban salah tangkap (Error in Persona) menurut perspektif Kitab Undang-Undang Hukum Acara Pidana (KUHAP) dan mengetahui dan menganalisis bentuk pertanggungjawaban yang dilakukan POLRI dalam hal ini sebagai penyidik kepada korban dalam hal terjadinya salah tangkap (Error in Persona) menurut perspektif Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Metode penelitian yang digunakan dalam penelitian ini yaitu penelitian hukum dengan pendekatan yuridis normatif, dengan menggunakan sumber bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data dalam penelitian ini yaitu menggunakan studi pustaka (library research). Jenis pendekatan penelitian dalam penelitian ini menggunakan Pendekatan Perundang-undangan (Statute Approach) dan Pendekatan Konseptual (Conceptual Approach). Teknik analisis data yang digunakan dalam penelitian ini yaitu secara deskriptif kualitatif. Hasil dari penelitian ini menunjukkan bahwa perlindungan korban salah tangkap telah dilindungi dan diberikan hak-hak berdasarkan Kitab Undang-Undang Hukum Pidana (KUHAP) Bab XII berupa ganti kerugian yang telah diatur menurut ketentuan Pasal 9 Peraturan Nomor 92 Tahun 2015 Tentang Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Tersangka atau Terdakwa yang menjadi korban salah tangkap (Error in Persona) yang dilakukan oleh aparat penegak hukum juga berhak mendapatkan rehabilitasi, yang telah diatur dalam ketentuan Pasal 1 Angka 23, Pasal 97 Ayat 1 & 2 dan Pasal 81 Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Pemberlakuan rehabilitasi bertujuan dalam upaya pemulihan dengan mengembalikan nama baik dari stigma buruk masyarakat, martabat dan kedudukan orang tersebut akibat dianggap sebagai tersangka meskipun diketahui bahwa hanya berstatus sebagai korban salah tangkap. Polisi sebagai penyidik juga dapat diminta pertanggungjawaban pidana jika terjadinya salah tangkap (Error in Persona) serta dapat dikenakan sanksi administrasi, sanksi perdata sampai dengan paling berat yaitu Pemecatan Dengan Hormat (PTDH)./The purpose of this research is to protect the law against victims of wrongful arrest (Error in Persona) according to the perspective of the Criminal Procedure Code (KUHAP) and to identify and analyze the form of accountability carried out by the Indonesian National Police in this case as an investigator to the victim in the event of a crime. arrest (Error in Persona) according to the perspective of the Criminal Procedure Code (KUHAP). The research method used in this research is legal research with a normative juridical approach, using primary legal materials, secondary legal materials and tertiary legal materials. The data collection technique in this research is using library research. The type of research approach is the Legislative Approach (Statute Approach) and the Conceptual Approach (Conceptual Approach). The data analysis technique used in this research is descriptive qualitative. The results of this study indicate that the protection of victims of wrongful arrests has been protected and given rights based on the Criminal Code (KUHAP) Chapter XII in the form of compensation which has been regulated according to the provisions of Article 9 of Regulation Number 92 of 2015 concerning the Book of Laws. Criminal Procedure (KUHAP). Suspects or defendants who are victims of wrongful arrests (Error in Persona) committed by law enforcement officers are also entitled to rehabilitation, which has been regulated in the provisions of Article 1 Number 23, Article 97 Paragraphs 1 & 2 and Article 81 of the Criminal Procedure Code. (KUHAP). The rehabilitation is aimed at restoring the good name from the bad stigma of the community, the dignity and position of the person as a result of being considered a suspect even though it is known that he is only a victim of wrongful arrest. The police as investigators can also be held criminally responsible if there is an Error in Persona and may be subject to administrative sanctions, civil sanctions up to the most severe, namely Dismissal with Respect (PTDH).
