Abstract

Tujuan penelitian ini adalah untuk mengetahui peranan hukum Penetapan Pengadilan dalam pelaksanaan jual beli dan pembuatan akta jual beli atas tanah waris milik anak di bawah umur dan pelaksanaan pengaturan hukum dalam jual beli dan pembuatan akta jual beli atas tanah waris milik anak di bawah umur melalui Penetapan Pengadilan. Metode penelitian yang digunakan penulis adalah metode penelitian normatif-empiris yang dilakukan dengan wawancara dan studi kepustakaan mengenai pelaksanaan jual beli dan pembuatan akta jual beli atas tanah waris milik anak di bawah umur melalui Penetapan Pengadilan. Hasil penelitian menunjukkan bahwa peranan hukum Penetapan Pengadilan dalam pelaksanaan jual beli dan pembuatan akta jual beli atas tanah waris milik anak di bawah umur sangat penting karena merupakan syarat dari Pejabat Pembuat Akta Tanah (PPAT) untuk membuat akta jual beli atas tanah waris milik anak di bawah umur, memberikan kejelasan dan kepastian hukum kepada semua pihak yang terlibat, serta memberikan perlindungan hukum bagi Pembeli maupun PPAT. Jika tidak ada Penetapan Pengadilan maka PPAT tidak dapat membuat akta jual beli. Jika tidak ada akta jual beli, maka pendaftaran ke Badan Pertanahan Nasional (BPN) untuk melakukan peralihan hak atas tanah tidak dapat dilakukan karena pendaftaran hanya dapat dilakukan jika dibuktikan dengan akta yang dibuat oleh PPAT. Pelaksanaan pengaturan hukum dalam jual beli dan pembuatan akta jual beli atas tanah waris milik anak di bawah umur melalui Penetapan Pengadilan dilaksanakan dengan menaati aturan hukum yang berlaku. Perjanjian jual beli dibuat dengan memenuhi syarat sahnya perjanjian dalam Pasal 1320 Kitab Undang-Undang Hukum Perdata (KUH Perdata), namun anak di bawah umur tidak memenuhi syarat kedua dalam syarat tersebut karena anak di bawah umur tidak cakap dan berada di bawah perwalian. Anak di bawah umur tersebut masih memiliki ibu kandung yang melakukan perwalian menurut Undang-Undang tanpa adanya Penetapan dari Pengadilan, sedangkan untuk membuat akta jual beli atas tanah waris milik anak di bawah umur tersebut harus ada Penetapan Pengadilan. Maka, ibu dari anak di bawah umur tersebut harus mengajukan permohonan penetapan di Pengadilan untuk mewakili anak-anaknya. Pengaturan hukum tentang jual beli dan pembuatan akta jual beli melalui Penetapan Pengadilan tidak diatur secara spesifik dalam Undang-Undang, maka dasar pertimbangan Hakim dalam menetapkan Penetapan Nomor: 28/Pdt.P/2017/PN.Stb adalah Pasal 330, 345 dan 383 KUH Perdata. Setelah semua syarat lengkap peralihan hak didaftarkan ke BPN./The purpose of this research is to find out the role of Court Order in the implementation of sales and purchase and the making of sales and purchase deed over inherited land belongs to underage children and the implementation of regulation of Law in sales and purchase and the making of sales and purchase deed over inherited land belongs to underage children through Court Order. The research method used by author is empirical-normative research method by conducting interview and library research regarding the implementation of sales and purchase and the making of sales and purchase deed over inherited land belongs to underage children through Court Order. The results of the research shows that the role of Court Order in the implementation of sales and purchase along with the making of sales and purchase deed of inherited land belongs to underage children are essential as it is a requirement of Land Deed Official in the making of sales and purchase deed of inherited land owned by underage children, to provide clarity and certainty of Law to parties involved, as well provide legal protection for buyer as well as Land Deed Official. If there’s no Court Order, Land Deed Official can’t make the sale and purchase deed. If there’s no sale and purchase deed, the registration to the National Land Affairs Agency can’t be done because it only can be registered if proven by Deed made by Land Deed Official. The implementation of regulation of Law in sales and purchase and the making of sales and purchase deed over inherited land belongs to underage children through Court Order done by obeying the applicable regulation of Law. Sales and purchase agreement made by fulfilling requirements of a valid aggrement in article 1320 of Civil Code, however underage children doesn’t meet the second requirement because minors is incompetent and under guardianship. The underage children still have a biological mother that carry out guardianship according to the Law without Court Order, while to make sales and purchase deed of inherited land owned by underage children there must be a Court Order. Then, the mother of underage children must apply a request to represent the minors. The regulation of Law about sales and purchase and the making of sales and purchase deed through Court Order is not regulated specifically in Constitution, therefore Legal basis for Judge in establishing the Court Order Number: 28/Pdt.P/2017/PN.Stb is article 330, 345 and 383 Civil Code. After the requirements are completed transfer of right is registered to the National Land Affairs Agency.
