Abstract

Tujuan penelitian ini adalah untuk mengetahui penetapan ganti rugi dalam pengadaan tanah untuk kepentingan umum dan penyelesaian sengketa ganti rugi dengan Studi Putusan Nomor: 10/Pdt.P /2017/PN Tng. Metode penelitian yang digunakan bersifat yuridis normatif yaitu menggunakan bahan kepustakaan sebagai data utama dalam menganalisis kasus dalam penyusunan penelitian. Metode pengumpulan data untuk melakukan penelitian adalah studi pustaka berupa mengkaji, membaca dan memahami Putusan Nomor 10/Pdt.P/2017/PN.Tng. Jenis pendekatan penelitian yang digunakan ialah kasus pendekatan dan Undang-undang. Data yang dikumpulkan akan dianalisis untuk mendapatkan jawaban atas permasalahan. Hasil penelitian menunjukkan bahwa nilai jual objek pajak akan dijadikan sebagai tolak ukur oleh lembaga penilai dalam menetapkan besaran ganti rugi dalam pengadaan tanah, nilai jual objek pajak merupakan nilai pajak atau nilai administrasi. Selain itu, terdapat faktor-faktor kerugian fisik dan kerugian non-fisik dari pelaksanaan pengadaan tanah. Dalam penetapan ganti rugi, jika pemilik tanah tidak setuju dengan hasil yang ditetapkan oleh lembaga penilai, maka pemilik tanah dapat melakukan musyawarah dengan ketua pelaksana pengadaan tanah. Namun jika masih belum terjadi kesepakatan antara pemilik tanah dengan ketua pelaksana pengadaan tanah setelah hasil musyawarah, maka pemilik tanah dapat mengajukan keberatan ke pengadilan negeri setempat. Dalam penyelesaian sengketa ganti rugi dalam putusan Nomor: 10/Pdt.P /2017/PN Tng, ketua pelaksana pengadaaan tanah tidak memenuhi aturan dalam penetapan ganti rugi yang tercantum pada Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum bahwa dalam penetapan ganti rugi, lembaga penilai akan memberikan hasil penilaian kepada ketua pelaksana pengadaan tanah untuk dimusyawarahkan besaran dan bentuk ganti ruginya, namun pada kasus ini ketua pelaksana pengadan tanah hanya memusyawarakan bentuk ganti ruginya. Selain itu, hakim mengesampingkan dalil-dalil terhadap asas keadilan dan kesejahteraan, dan hakim juga keliru dalam mengambil keputusan karena mengutamakan pendapat ahli dan menolak acuan yang berstandar pada ketentuan yang tercantum di dalam Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum. / The purpose of this study was to determine the determination of compensation in land acquisition for the public interest and settlement of compensation disputes with Decision Study Number: 10/Pdt.P /2017/PN Tng. The research method used is normative juridical, namely using library materials as the main data in analyzing cases in the preparation of research. The data collection method for conducting research is literature study in the form of reviewing, reading and understanding Decision Number 10/Pdt.P/2017/PN Tng. The type of research approach used is the case approach and the law. The data collected will be analyzed to get answers to the problems. The results show that the selling value of the tax object will be used as a benchmark by the appraisal agency in determining the amount of compensation in land acquisition, the selling value of the tax object is the tax value or administrative value. In addition, there are factors of physical losses and non-physical losses from the implementation of land acquisition. In determining compensation, if the land owner does not agree with the results determined by the appraisal agency, then the land owner can hold consultations with the chief executive of land acquisition. However, if there is still no agreement between the land owner and the chief executive of land acquisition after the results of the deliberation, then the land owner can file an objection to the local district court. In the settlement of the compensation dispute in the decision Number: 10/Pdt.P /2017/PN.Tng, the chief executive of land acquisition did not meet the rules in determining compensation as stated in Law Number 2 of 2012 concerning Land Procurement for Development in the Public Interest. that in determining compensation, the appraisal agency will provide the results of the assessment to the chief executive of land acquisition to discuss the amount and form of compensation, but in this case the chief executive of land acquisition only discusses the form of compensation In addition, the judge overruled the arguments against the principles of justice and welfare, and the judge was also wrong in making decisions because he prioritized expert opinion and refused standardized references to the provisions contained in Law Number 2 of 2012 concerning Land Procurement for Development for the Interests.
