Abstract

Tujuan penulisan ini untuk mengetahui apa sanksi bagi Notaris yang melakukan kelalaian dalam menyimpan minuta akta dan perlindungan hukum terhadap pihak yang telah dirugikan terhadap kelalaian yang dilakukan oleh seorang Notaris. Penelitian ini menggunakan jenis penelitian studi kepustakaan, dan juga dilakukan penelitian di lapangan atau penelitian yang diperoleh secara langsung dari masyarakat maupun dari lingkungan sekitarnya. Teknik pengumpulan data dalam penelitian ini dilakukan melalui jenis penelitian normatif yang dimana penelitian tersebut dilakukan dengan studi Pustaka baik dari buku maupun jurnal yang berkaitan dengan rumusan masalah serta melakukan pengumpulan data dengan penelitian empiris yang dimana dilakukan dengan wawancara dengan narasumber yang mengetahui secara jelas dan paham dalam permasalahan yang tersebut. Hasil dari penelitian adalah minuta akta wajib disimpan ditempat yang aman agar tidak hilang maupun rusak. Tanggung jawab Notaris atas hilangnya atau rusaknya minuta akta dapat dikenakan sanksi atas kelalaian yang dilakukan oleh Notaris tersebut. Abstrak ini membahas tentang Pertanggung Jawaban Hukum Notaris terhadap kelalaian yang dilakukan oleh Notaris tersebut dalam penyimpanan Minuta Akta dimana ada kaitannya dengan masalah pokok dalam penelitian ini adalah Pertanggung Jawaban Hukum Notaris terhadap kelalaian yang dilakukannya dan Perlindungan Hukum terhadap pihak yang dirugikan terhadap kelalaian yang dilakukan oleh seorang Notaris. Notaris dalam menjalakan Jabatannya yang mempunyai kewajiban dalam menyimpan minuta akta di tempat yang aman yang sebagaimana telah diatur dalam UUJN. Notaris selaku Pejabat Umum mempunyai kewenangan dalam membuat akta otentik, dan Notaris memiliki kewajiban untuk membuat akta dalam bentuk minuta akta, dalam menjalakan tugasnya juga harus mematuhi prosedur bagaimana cara menyimpan minuta akta yang telah di atur dalam UUJN. Dimana akta tersebut akan menjadi dokumen negara yang harus dijaga, dirawat dan di simpan di tempat yang aman agar tidak terjadi suatu hal yang tidak diinginkan seperti hilang ataupun rusak. Jika minuta akta tersebut hilang atau rusak maka dapat dikatakan Notaris telah melakukan kelalaian dalam menjalankan tugasnya dan akan mendapatkan sanksi./The purpose of this writing is to find out what the sanctions are for a notary who neglects to keep the minimum deed and legal protection for parties who have been harmed against negligence by a notary. This research uses literature study research, and also conducts research in the field or research that is obtained directly from the community or from the surrounding environment. The data collection technique in this research is carried out through the type of normative research in which the research is carried out with literature studies both from books and journals related to the formulation of the problem and by collecting data with empirical research which is carried out by interviewing sources who know clearly and understand in that problem The result of the research is that the minimum deeds must be stored in a safe place so that they are not lost or damaged. The notary's responsibility for the loss or damage of the Minuta deed may be subject to sanctions for negligence committed by the Notary. this abstract discuss the Notary's Legal Liability for negligence committed by the Notary in the Minuta Deed, which is related to the main problem in this research, namely Notary Legal Liability for negligence and Legal Protection for the injured party against negligence. by a notary. Notary in exercising his position who has the obligation to keep the minimum deed in a safe place as regulated in the Law on the Position of Notary.Notaries as General Officials have the authority to make authentic deeds, and Notaries have the obligation to make deeds in the form of deeds, in carrying out their duties they must also comply with the procedure on how to keep the minimum deeds that have been regulated in the Law of Notary Position. Where is the deed will be a state document that must be preserved, cared for and stored in a safe place so that something undesirable such as loss or damage does not occur. If the minimum deed is lost or damaged, it can be said that the Notary has neglected in carrying out his duties and will be sanctioned.
