Abstract

Tujuan Penelitian ini adalah mengetahui dan memahami perlindungan hukum terhadap royalti pemegang hak cipta lagu yang diputar di tempat karaoke Kota Medan, mengetahui mekanisme pembagian royalti pemegang hak cipta lagu di tempat karaoke Kota Medan dan mengetahui upaya hukum yang dapat dilakukan pemegang hak cipta apabila pemilik tempat karaoke tidak memberikan royalti kepada pemegang hak cipta. Metode penelitian hukum yang digunakan dalam penelitian ini adalah penelitian yuridis normatif yang merupakan penelitian yang dilakukan atau di tujukan hanya pada peraturan-peraturan yang tertulis dengan sifat penelitian deskriptif analisis yang merupakan suatu metode yang berfungsi untuk mendeskripsikan atau memberi gambaran terhadap objek yang diteliti melalui data atau sampel dan membuat kesimpulan yang berlaku untuk umum. Sumber data yang digunakan dalam penelitian ini adalah data primer dan sekunder dan analisis data kualitatif yang merupakan pengamatan fenomena yang di peroleh dari data-data yang di peroleh. Hasil dari penelitian ini adalah perlindungan hukum terhadap royalti pemegang hak cipta lagu yang diputar di tempat karaoke Kota Medan belum cukup memadai karena belum adanya peraturan daerah yang khusus atau secara spesifik mengatur mengenai kewajiban royalti oleh penyelenggara tempat karaoke di Kota Medan Penyelenggaraan perizinan Karaoke di Kota Medan sendiri didasarkan pada Peraturan Walikota Medan No 41 Tahun 2018, saat ini perlindungan hukum terhadap royalti pemegang hak cipta lagu yang diputar di tempat karaoke Kota Medan hanya berdasarkan kepada Undang-Undang Hak Cipta. Pelaksanaan praktek pembayaran royalti pada tempat usaha karaoke yang diwawancarai penulis, Inul Vizta Center Point Medan, dilakukan dengan pembayaran tiap kamar (room) dihitung perhari tetapi pembayarannya dilakukan setahun yang dibayarkan kepada YKCI. Hubungan hukum antara Inul Vizta Center Point Medan dan YKCI sendiri didasarkan pada kontrak lisensi penggunaan lagu yang berlaku selama 3 tahun dimana Inul Vizta berhak menggunakan semua lagu yang terdaftar pada YKCI. Distribusi atas lagu yang digunakan oleh Inul Vizta sendiri dilakukan oleh YKCI atas permintaan Inul Vizta setiap 3 bulan sekali yang kemudian YKCI menawarkan lagu-lagu baru yang berada dibawah lisensi YKCI. Lagu yang ingin diputar oleh Inul Vizta sendiri diberikan oleh YKCI dalam bentuk CD yang kemudian di pasang pada mesin karaoke./ The purpose of this study is to know and understand the legal protection of the royalties of the copyright holders of songs played in karaoke places in Medan City, to know the mechanism of distribution of royalties for song copyright holders at karaoke places in Medan City and to know the legal remedies that copyright holders can take if the owners of karaoke places does not provide royalties to copyright holders. The legal research method used in this research is normative juridical research which is research conducted or aimed only at written regulations with the nature of descriptive analysis research which is a method that functions to describe or provide an overview of the object under study through data or samples and make conclusions that apply to the general. Sources of data used in this study are primary and secondary data and qualitative data analysis which is the observation of phenomena obtained from the data obtained. The result of this research is that the legal protection of the royalty of song copyright holders played at karaoke venues in Medan City is not sufficient because there is no specific or specific regional regulation regarding the obligation of royalty by karaoke venues in Medan City. itself is based on Medan Mayor Regulation No. 41 of 2018, currently the legal protection of royalties for song copyright holders played at karaoke venues in Medan is only based on the Copyright Law. The implementation of the practice of paying royalties at the karaoke business place interviewed by the author, Inul Vizta Center Point Medan, is carried out by paying for each room calculated per day but the payment is made a year which is paid to YKCI. The legal relationship between Inul Vizta Center Point Medan and YKCI itself is based on a song license contract that is valid for 3 years where Inul Vizta has the right to use all songs registered with YKCI. The distribution of songs used by Inul Vizta itself is carried out by YKCI at Inul Vizta's request every 3 months, then YKCI offers new songs under the YKCI license. The song that Inul Vizta wanted to play was provided by YKCI in the form of a CD which was then installed on the karaoke machine.
