Abstract

Tujuan penelitian ini adalah untuk mengetahui ketentuan pemberlakuan kebijakan Pembatasan Sosial Berskala Besar dalam bidang ekonomi, psikologi dan kesehatan dari aspek kemanfaatan hukum serta dampak dari pemberlakuan Pembatasan Sosial Berskala Besar (PSBB) terhadap ketenagakerjaan di Indonesia. Metode penelitian ini menggunakan jenis penelitian yang bersifat normatif empiris dengan menganalisa norma hukum positif yang berkaitan dengan masalah. Dalam penelitian, peneliti data primer yaitu hasil kuisioner yang dilakukan secara online terhadap 150 responden kemudian meneliti data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Metode pengumpulan data penelitian dilakukan melalui studi pustaka baik dari Undang-undang, berita yang terkait dengan permasalahan yang sedang diteliti. Jenis pendekatan penelitian yang digunakan ialah pendekatan penelitian kualitatif dengan mengumpulkan, menganalisa dan menginterpretasi data primer dan data sekunder. Data yang dikumpulkan oleh penulis akan dianalisis dengan menggunakan teknik analisis data deskriptif untuk mendapatkan jawaban atas permasalahan. Hasil dari penelitian menunjukkan bahwa kebijakan PSBB kurang efektif karena tidak tegas dalam pelaksanaannya. Regulasi PSBB juga sangat mempengaruhi kehidupan masyarakat Indonesia terutama dalam bidang ekonomi, psikologi, kesehatan dan ketenagakerjaan. Dalam bidang ekonomi, pengusaha banyak mengalami penurunan pendapatan hingga terjadi PHK. Masyarakat yang kehilangan pekerjaan secara otomatis tidak dapat memenuhi kebutuhan hidupnya cenderung menimbulkan stress hingga depresi. Jika dikaitkan dengan UUD 1945, kebijakan PSBB tidak memenuhi Pasal 28H (1) dan Pasal 33 (3) sehingga dianggap kurang efektif karena tidak memberikan perlindungan hukum terhadap Kesehatan masyarakat. Dampak yang di timbulkan dari Pembatasan Sosial Berskala Besar (PSBB) terhadap penekanan angka COVID-19 memang memberikan hasil yang baik namun tidak terhadap nasib ketenagakerjaan di Indonesia. Pemutusan Hubungan Kerja yang dilakukan oleh pengusaha tentu harus memenuhi Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan namun pekerja yang terkena PHK tetap mendapatkan haknya masing-masing satu kali atas uang pesangon pesangon, uang penghargaan masa kerja sebesar dan uang penggantian hak sesuai pasal 156 UU Ketenagakerjaan./The purpose of this study is to find out the provisions of the implementation of large-scale social restriction policies in the field of economics, psychology and health from the aspects of legal benefits and the impact of the implementation of Large-Scale Social Restrictions (PSBB) on employment in Indonesia. This research method uses a type of research that is empirical normative by analyzing positive legal norms related to the problem. In the study, primary data researchers quizzed 150 respondents online and then examined secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The method of collecting research data is conducted through the study of libraries both from the Law, news related to the problem being studied. The type of research approach used is qualitative research approach by collecting, analyzing and interpreting primary data and secondary data. The data collected by the author will be analyzed using descriptive data analysis techniques to get answers to problems. The results of the study showed that psbb policy is less effective because it is not firm in its implementation. PSBB regulation also greatly affects the lives of Indonesians, especially in the fields of economy, psychology, health and employment. In the field of economics, entrepreneurs experience a lot of decreased income until layoffs occur. People who lose their jobs automatically are unable to meet their life needs tend to cause stress to depression. If associated with the 1945 Constitution, psbb policy does not meet Article 28H (1) and Article 33 (3) so it is considered less effective because it does not provide legal protection to public health. Termination of Employment conducted by employers must certainly comply with Law No. 13 of 2003 on Employment but workers affected by layoffs still get their rights once each time for severance money, award money for employment and reimbursement of rights in accordance with article 156 of the Labor Law. The impact of Large-Scale Social Restrictions (PSBB) on the suppression of COVID-19 figures does provide good results but not on the fate of employment in Indonesia. Termination of Employment conducted by employers must certainly comply with Law No. 13 of 2003 on Employment but workers affected by layoffs still get their rights once each time for severance money, award money for employment and reimbursement of rights in accordance with article 156 of the Labor Law.
