Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan perlindungan hukum bagi konsumen terhadap beredarnya produk yang tidak didaftarkan di Badan Pengawas Obat dan Makanan (BPOM) yang membahayakan kesehatan konsumen dan pertanggungjawaban terhadap pelaku usaha yang tidak mendaftarkan produknya di Badan Pengawas Obat dan Makanan (BPOM) yang membahayakan kesehatan konsumen. Penelitian ini menggunakan metode penelitian hukum normatif empiris. Teknik pengumpulan data pustaka dan dengan menyebarkan kuesioner tertutup secara online dan menganalisis produk hukum yang berkaitan dengan objek yang diteliti. Penelitian dilakukan dengan mengumpulkan data primer terlebih dahulu kemudian menguji efektivitas dari penerapan hukum tersebut dalam peraturan perundang-undangan yang berlaku, kemudian diolah secara kualitatif berupa grafik dan narasi. Hasil penelitian menunjukkan bahwa pelaksanaan perlindungan hukum terhadap produk yang tidak didaftarkan oleh BPOM terutama dalam pengawasan produk illegal yang beredar masih belum terlaksana dengan baik walaupun pengawasan produk setelah beredar terdapat ribuan temuan terhadap produk yang tidak memenuhi standar telah dilakukan pemusnahan. Kurangnya kesadaran dan pengetahuan dari masyarakat mengenai hak yang dilindungi dan diperoleh di dalam hukum perlindungan konsumen. Pertanggungjawaban pelaku usaha terhadap konsumen yang tidak adanya perjanjian dapat berupa Product Liability dan tidak terlepas pertanggungjawaban terhadap Negara berupa Criminal Responsibility. Sanksi yang dapat dijatuhkan yaitu sanksi administratif (peringatan tertulis, larangan mengedarkan Kosmetika, penarikan dan pemusnahan Kosmetika), sanksi perdata (kompensasi ganti rugi/perawaatan kesehatan yang diderita), sanksi pidana (pidana penjara dan denda) maupun sanksi tambahan./ This study aims to determine the implementation of legal protection for consumers against the circulation of products that are not registered with the Food and Drug Supervisory Agency (BPOM) which endanger the health of consumers and the responsibility of business actors who do not register their products with the Food and Drug Supervisory Agency (BPOM) which endanger health consumer. This study uses a juridical normative research method. Data collection techniques by distributing closed questionnaires online and analyzing legal products related to the object under study. The research was conducted by collecting primary data first and then testing the effectiveness of the application of the law in the prevailing laws and regulations then processed qualitatively in the form of graphics and narration. The results showed that the implementation of legal protection against products that are not registered by BPOM, especially in the supervision of illegal products in circulation is still not carried out properly even though product supervision after circulating there are thousands of findings on products that do not accordant the standards have been carried out destruction. Lack of awareness and knowledge from the public regarding the rights protected and obtained in consumer protection law. The responsibility of business actors to consumers in the absence of an agreement can be in the form of Product Liability and cannot be separated from accountability to the State in the form of Criminal Responsibility. Sanctions that can be imposed are administrative sanctions (written warning, prohibition of distributing Cosmetics, withdrawal and destruction of Cosmetics), civil sanctions (compensation for compensation/health care suffered), criminal sanctions (imprisonment and fines) as well as additional sanctions.
