Abstract

Tujuan dari penelitian ini adalah untuk mengetahui secara baik dan komprehensif polemik pelaksanaan pilkada serentak di tengah pandemi COVID-19 dari segi kelebihan dan kelemahan dan untuk dapat merumuskan strategi guna mewujudkan pesta demokrasi yang berintegritas Pancasila di Indonesia untuk pemilu yang akan datang. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan metode penelitian kepustakaan (library research). Penelitian ini menggunakan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Pengumpulan bahan hukum dalam penelitian ini adalah teknik dokumenter. Pendekatan penelitian yang digunakan adalah pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach) yang kemudian dianalisis dengan menggunakan teknik analisis secara kualitatif. Hasil penelitian dan pembahasan menyatakan bahwa terdapat kelebihan dan kelemahan dalam pelaksanaan Pilkada Serentak di tengah Pandemi COVID-19. Kelebihan dari pelaksanaan Pilkada 2020 ditinjau dari parameter proses pemilihan umum dan partisipasi politik yang menunjukkan tingkat kedisiplinan penyelenggara dan partisipan pilkada dalam menerapkan protokol COVID-19 yang tertib dan meningkat, penggunaan sistem elektronik yang dapat membantu meningkatkan kepercayaan publik terhadap proses pilkada 2020 dan adanya peningkatan pada jumlah partisipasi warga sebesar 76%. Adapun kelemahannya adalah ditinjau dari parameter kebebasan sipil, fungsi pemerintahan dan budaya politik yang menunjukkan inkonsistensi dari pemerintah, pemerintah mengabaikan aspirasi dan kehendak rakyat yang tidak sejalan dengan amanat Pasal 1 ayat (2) UUD 1945 “Kedaulatan berada di tangan rakyat dan dilaksanakan menurut Undang-Undang Dasar”. Secara teoritis, Pilkada Serentak 2020 mencerminkan kebijakan Pemerintah lebih mengedepankan legitimasi kekuasaan berdasarkan law enforcement daripada supremacy of law. Berangkat dari hasil evaluasi Pelaksanaan Pilkada Serentak 2020 maka dapat dirumuskan strategi yang dapat diterapkan oleh pemerintah Indonesia kedepannya agar tercapai pesta demokrasi yang berintergritas Pancasila yakni dapat dilakukan dengan perbaikan dari segi regulasi, penyelenggara dan penyelenggaraan. Yang pertama, perlunya perbaikan regulasi yaitu penguatan BAWASLU, pengaturan terkait pencegahan dan pemberantasan negative dan black campaign. Yang kedua, dari segi penyelenggara perlu dilakukan penataan kelembagaan dan keanggotaan KPU hingga KPPS yang lebih berkualitas serta Yang terakhir dari segi penyelenggaraan perlunya kolaborasi antara regulasi dan subjek penyelenggara yang baik dengan memakai sarana dan prasarana yang terintegrasi dengan kemajuan teknologi kiranya dapat diupayakan lebih baik lagi kedepannya untuk semakin memantapkan prinsip dari pemilu atau pilkada serentak itu sendiri yakni langsung, umum, bebas, rahasia, jujur dan adil. / The aim of this study was to properly and comprehensively find out the polemics of implementing simultaneous regional elections in the midst of the COVID-19 pandemic in terms of strengths and weaknesses and to be able to formulate strategies to realize a democratic party with Pancasila integrity in Indonesia for the upcoming elections. This study was a normative legal research by using library research as the method of this study. This study used secondary data which contain of primary legal materials, secondary legal materials, and tertiary legal materials. The technique used to collect the data in this study was documentation technique. Statute approach and conceptual approach were used in this study which then analyzed qualitatively. The findings of topic discussion showed that there were strengths as well as weaknesses in implementing simultaneous regional elections in the midst of the COVID-19 pandemic. The strengths in implementing 2020 general election are viewed from the parameters of the general elections process and political participation which show the level of discipline of the organizers and participants in implementing an orderly and proper COVID-19 protocol, the use of electronic systems can help increase public confidence in the 2020 general elections process and the number of citizen participation is increase by 76%. The weakness is that in terms of the parameters of civil liberties, the function of government and political culture which shows inconsistencies from the government, and the government neglected the people’s aspirations and wishes by violating the provisions of Article 1 Section (2) of the 1945 Constitution of The Republic of Indonesia “Sovereignty is in the hands of the people and implemented according to the Constitution”. Theoretically, the 2020 elections implementation reflects government policies to put forward the legitimize power based on law enforcement than supremacy of law. From the results in evaluating the implementation of 2020 simultaneous general elections, a formulated strategy that can be applied by the Indonesian government in the future in order to achieve a democratic party with Pancasila integrity are improving the regulations, organizers and implementation. First, the need for regulatory improvements, namely strengthening the BAWASLU, regulations related to the negative prevention and eradication and black campaigns. Second, from the point of view of the organizers, it is necessary to arrange a more qualified institutions and membership of the KPU to the KPPS. Finally, in terms of implementation, the need of collaboration between regulations and good administrators by using facilities and infrastructure that are integrated with technological advances, it is expected that better efforts can be made in the future to further strengthen the principles of the simultaneous general election or regional election itself, namely direct, general, free, confidential, honest and fair.
