Abstract

Tujuan penelitian ini adalah untuk mengetahui hak dan kewajiban Tenaga Kerja dan Perusahaan. Tujuan yang kedua adalah pertimbangan hukum oleh Majelis Hakim dalam memutus Perkara Nomor: 302/Pdt.Sus-PHI/2019/PN.Mdn. Metode penelitian yang digunakan pada penelitian ini adalah yuridis normatif yaitu menggunakan bahan kepustakaan sebagai data utama dalam menganalisis kasus. Metode pengumpulan data penelitian dilakukan melalui studi pustaka yaitu dengan cara membaca, mengkaji, dan memahami isi salinan Putusan No. 302/Pdt.Sus-PHI/2019/PN.Mdn. Jenis pendekatan penelitian yang digunakan ialah pendekatan Undang-Undang dan konseptual. Data yang diperoleh selama penelitian akan disusun secara sistematis dan selanjutnya dianalisis secara kualitatif untuk mencapai kejelasan masalah yang akan dibahas. Hasil penelitian menunjukkan bahwa terdapat hak-hak Tenaga Kerja yang tidak dipenuhi oleh Perusahaan pada Putusan Nomor: 302/Pdt.Sus-PHI/2019/PN.Mdn. Hak-hak tersebut berupa upah dan pesangon akibat dari dilakukannya Pemutusan Hubungan Kerja. Hak-hak tersebut seharusnya merupakan kewajiban dari Perusahaan karena telah mempekerjakan Tenaga Kerja. Akibat dari tidak terpenuhinya hak Tenaga Kerja tersebut adalah Tenaga Kerja tidak mendapatkan penghidupan yang layak untuk dirinya dan keluarganya. Pertimbangan Hakim dalam memutus Perkara Nomor: 302/Pdt.Sus-PHI/2019/PN.Mdn terdapat kekeliruan. Kekeliruan tersebut dikarenakan Majelis Hakim mengabulkan gugatan mengenai upah proses selama penetapan Pemutusan Hubungan Kerja. Upah proses seharusnya dibayarkan apabila Tenaga Kerja masih menjalankan kewajibannya selama proses penetapan Pemutusan Hubungan Kerja, sementara dalam perkara ini, Tenaga Kerja tidak menjalankan kewajibannya selama proses penetapan tersebut, maka dari itu seharusnya Perusahaan pun tidak wajib untuk membayarkan upah proses penetapan Pemutusan Hubungan Kerja kepada Tenaga Kerja. / The purpose of this research is to find out the rights and obligations of Labor and Compan. The second purpose is the legal considerations by the Panel of Judges in deciding Case Number: 302/Pdt.Sus-PHI/2019/PN.Mdn. The research method used in this study is normative juridical, namely using library materials as the main data in analyzing cases. The research data collection method was carried out through library research, namely by reading, reviewing, and understanding the contents of the copy of Decision No. 302/Pdt.Sus-PHI/2019/PN.Mdn. The type of research approach used is the legal and conceptual approach. The data obtained during the research will be compiled systematically and then analyzed qualitatively to achieve clarity of the problems to be discussed. The results of the study show that there are Labor rights that are not fulfilled by the Company in Decision Number: 302/Pdt.Sus-PHI/2019/PN.Mdn. These rights are in the form of wages and severance pay as a result of the Termination of Employment. These rights should be an obligation of the Company because it has employed Labor. As a result of the non-fulfillment of the rights of these Labors, the Labors do not get a decent living for themselves and their families. The judge's consideration in deciding Case Number: 302/Pdt.Sus-PHI/2019/PN.Mdn there was an error. The error was due to the fact that the Panel of Judges granted the claim regarding the wages process during the determination of Termination of Employment. Process wages should be paid if the Labors are still carrying out their obligations during the process of determining the Termination of Employment, while in this case, the Labors do not carry out their obligations during the determination process, therefore the Company should not be obliged to pay wages for the process of determining the Termination of Employment to the Workers.
