Abstract

Tujuan penelitian terhadap kasus kekerasan seksual terhadap anak dibuat oleh penulis adalah untuk mengetahui penerapan perundang-undangan di Indonesia untuk mencegah terjadinya kekerasan seksual terhadap anak dan untuk mengetahui bentuk perlindungan anak sebagai korban kekerasan seksual di Indonesia. Penelitian ini menggunakan penelitian metode yuridis normatif, yang meneliti perkara dengan menganalisa. Jenis data penelitian ini adalah dengan deskriptif analisis, yaitu dengan menggambarkan kasus dan menelaah kasus. Pengumpulan data dengan studi putusan, undang-undang, jurnal, buku, dan artikel internet. Data dianalisis dengan memberi penafsiran hukum dan dijelaskan dengan mendeskripsikan untuk memecahkan persoalan yang timbul. Hasil penelitian ini adalah kasus kekerasan seksual terhadap anak merugikan anak dari segi fisik dan mental. Seperti dalam kasus Putusan Nomor 1579/Pid.SUS/2015/PN-Mdn, ayah kandung yang seharusnya memberikan perlindungan kepada putrinya, dalam kenyataan justru melakukan tindakan kekerasan seksual kepada kedua anak kandungnya. Anak yang sebagai korban kekerasan seksual mengalami luka pada selaput darah dan trauma yang membutuhkan perawatan dalam waktu yang cukup lama untuk pemulihan jiwa korban. Hukum mengenai perlindungan anak dan ancaman pidana kepada pelaku kekerasan seksual terhadap anak telah tersedia. Permasalahan yang timbul adalah lemahnya penegakan hukum perlindungan anak dan kurangnya perhatian kepada anak yang sebagai korban kekerasan seksual. Pemerintah dalam melaksanakan tugas tetap menjunjung tinggi nilai kebenaran dan kejujuran. Keluarga sebagai orang yang dipercayai Tuhan untuk menjaga anak seharusnya dapat memberikan anak lingkungan yang aman dan nyaman, memberikan anak tumbuh sehat baik jasmani maupun rohani, memberikan anak pendidikan moral dan agama agar memiliki dasar untuk menghadapi masyarakat dan iman yang kuat. Masyarakat juga diharapkan untuk tidak melakukan tindakan diskriminasi terhadap anak sebgai korban kekerasan seksual. Harapan penulis adalah pemerintah, masyarakat, dan keluarga dapat bekerja sama dalam memberikan perlindungan yang terbaik kepada anak untuk menjaga generasi penerus bangsa. / The purpose of this research of cases of sexual violence against children made by the author is to find out the application of legislation in Indonesia to prevent sexual violence against children and to find out the forms of protection of children as victims of sexual violence in Indonesia. This study uses a normative juridical research method, which examines cases by analyzing. This type of research data is descriptive analysis, namely by describing cases and examining cases. Data collection by study of sentences, constitutions, journals, books, and internet articles. The data are analyzed by giving legal interpretation and explained by describing to solve the problems that arise. The results of this study are case of sexual violence against children harm children in their physical health and mental health. As in the case of Sentences Number 1579/Pid.SUS/2015/PN-Mdn, the biological father who was supposed to provide protection for his daughter, in fact committed acts of sexual violence against his two biological children. Children who are victims of sexual violence suffer injuries to the blood membranes and trauma that require treatment for a long time to recover the victim's mental health. Laws regarding child protection and criminal threats against perpetrators of sexual violence against children are available. The problems that occurred are the weak enforcement of child protection laws and the lack of attention to children who are victims of sexual violence. In carrying out its duties, the government need to uphold the values of truth and honesty. Families as people who are trusted by God to take care of children should be able to provide a safe and comfortable environment for children, provide the children to grow healthily both physically and spiritually, provide children with moral and religious education so that they have a basis for facing society and strong faith. The community is also expected not to discriminate against children as victims of sexual violence. The author's hope is that the government, society, and families can work together in providing the best protection for children to protect the nation's next generation.
