Abstract

Law Number 5 of 1960 concerning Basic Agrarian Principles is the main law in effect in Indonesia relating to ownership of land rights, through the policy of drafting Law Number 11 of 2020 concerning Job Creation, the Government aims to improve the national economy and opening up jobs by building an investment ecosystem through the provision of facilities for foreigners thereby increasing foreign exchange. The purpose of writing this thesis is to analyze the arrangement of home ownership for foreigners in terms of Law No.11 of 2020 concerning Job Creation and other implementing regulations, as well as the role of Land Deed Making Officials (PPAT) in relation to ownership of foreigners' residences. This research is a qualitative or non-doctrinal research where the way it works can find hidden reasons behind the actions of the perpetrators of social action or discover the social meaning of a phenomenon. This study uses a sociological or socio-legal approach which is a study that combines doctrinal and non-doctrinal matters. From the results of this study, it can be concluded that the first regulation is related to the residential ownership of foreigners after the 2015 Economic Policy Package and renewal of the policy through the Omnibus Law, the formulation of Law Number 11 of 2020 concerning Job Creation, namely placing the right facilities, which can be owned residential people. foreigners outside the Special Economic Zones with certain criteria and conditions, while those in Special Economic Zones with facilities to absorb investment are given concessions. The second role of the notary / PPAT in implementing the housing arrangement for foreigners, which is currently strictly divided outside the Zone and inside the Special Economic Zones, has become a central pattern by requiring the Notary Position / PPAT to participate in building an investment ecosystem with adjustments to location which have implications for handlers and limits that can be done. / Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria adalah undang-undang pokok yang berlaku di Indonesia berkaitan dengan kepemilikan hak atas tanah, melalui kebijakan penyusunan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, Pemerintah bertujuan untuk meningkatkan perekonomian nasional dan membuka lapangan pekerjaan dengan membangun ekosistem investasi melalui pemberian fasilitas bagi orang asing dengan demikian dapat meningkatkan devisa. Tujuan penulisan tesis ini adalah untuk menganalisis mengenai pengaturan kepemilikan rumah bagi orang asing ditinjau dari Undang-Undang No.11 Tahun 2020 tentang Cipta Kerja dan Peraturan Pelaksanaan lainnya, serta peran Pejabat Pembuat Akta Tanah (PPAT) sehubungan dengan kepemilikan tempat tinggal orang asing. Penelitian ini merupakan penelitian kualitatif atau non doktrinal yang cara kerjanya dapat menemukan alasan-alasan (reasons) dan makna sosial (social meaning) dari suatu fenomena. Penelitian ini menggunakan pendekatan Yuridis Sosiologis atau socio legal yang merupakan kajian yang memadukan doktrinal dengan non doktrinal. Dari hasil penelitian ini dapat disimpulkan bahwa pertama pengaturan terkait dengan kepemilikan hunian orang asing pasca Paket Kebijakan Perekonomian tahun 2015 dan dilakukan pembaharuan kebijakan melalui Omnibus Law penyusunan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yakni meletakan fasilitas yang tepat, dimana dapat dimiliki hunian orang asing di luar Kawasan Ekonomi Khusus dengan kriteria dan syarat tertentu sedangkan di Kawasan Ekonomi Khusus yang berfasilitas untuk menyerap investasi diberikan kelonggaran. Kedua peranan notaris/PPAT dalam implementasi pengaturan kepemilikan hunian orang asing yang saat ini terbagi secara ketat di di luar Kawasan dan di dalam Kawasan Ekonomi Khusus menjadi sebuah pola yang sentral dengan mengharuskan Jabatan Notaris/PPAT ikut membangun ekosistem investasi dengan penyesuaian terhadap lokasi yang berimplikasi terhadap penanganan serta batasan yang dapat dilakukan.
