Abstract

Indonesia memasuki era baru dalam pengadaan kontrak atau perjanjian dengan penggunaan internet sebagai media pelaksanaannya. Perjanjian melalui Internet dapat menggunakan perjanjian pra-kontrak terlebih dahulu, salah satunya dengan menggunakan Letter of Intent. Kedudukan serta keabsahan atas suatu Letter of Intent di Indonesia sebagai perjanjian maupun alat bukti dalam suatu persidangan perdata masih belum memiliki kejelasan, karena Letter of Intent sejatinya merupakan perjanjian pra-kontrak. Penulis melalui pengolahan data sekunder dengan metode normative serta pendekatan undang-undang dan kasus, untuk mengkaji kedudukan dari Letter of Intent baik secara elektronik maupun konvensional yang belum diatur oleh Hukum Perjanjian Indonesia, KUHPerdata, maupun UU ITE. Meskipun demikian Letter of Intent yang dituangkan dalam bentuk surat elektronik tetap berlaku sebatas dengan apa yang diperjanjikan di dalam Letter of Intent dan surat elektronik merupakan informasi elektronik yang dikategorikan sebagai alat bukti elektronik sebagaimana dimaksud pasal 5 UU ITE. Kata Kunci: Letter of Intent, Perjanjian, Surat Elektronik / Indonesia is entering a new era of procuring contracts or agreements with the internet as a medium for its implementation. Agreements via the internet can use pre-contract agreements in advance, one of which is by using a Letter of Intent. The position and validity of the Letter of Intent in Indonesia as an agreement or evidence in a civil trial is still unclear, because the Letter of Intent is actually a pre-contract agreement. The author performs secondary data processing using normative methods as well as legal and case approaches, to see Indonesian legal views on Letters of Intent both electronically and conventionally that have not been regulated in the Indonesian Covenant Law, Civil Code, or ITE Law. Nevertheless, the Letter of Intent which is in the form of an electronic letter remains valid with what agreed upon in letter of intent and an electronic letter is electronic information which categorized as electronic evidence as referred to in Article 5 of the ITE Law.
