Abstract

The problem of music copyright in the YouTube media is quite serious. The main dispute that arise on YouTube are not easy to resolve, existing problems can be resolved through dispute resolution in court or out of court base on the Copyright Law and the Arbitration and Alternative Dispute Resolution Act, but the problem of resolving Music Copyright in YouTube needs to be studied further to be able to maximize the alternative dispute resolution that already exist. Music Copyright Dispute which brings loss of moral rights and economic rights. The purpose of this study is to examine the problems, the first is about the mechanism of dispute resolution of music copyright according to the Copyright Act. Second, the implementation of alternative arrangements for resolving music copyright disputes on YouTube. This research uses a normative method with a law approach, a case approach, and a conceptual approach. Sources of legal materials used come from primery, secondary, and tertiary legal materials. Data collection techniques using literature study techniques and through interviews. The result of the study show that, first od all, it explains the mechanism for resolving Copyright so that it is explained in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution as contained in Article 6 paragraphs (1) to (9) which explains the alternative dispute resolution process and Articles 27 to 51 describe the arbitration process. Second, solution that can be used in the settlement of Copyright disputes can refer to Article 95 paragraph (1) of Law Number 28 of 2014 concerning Copyright and Discussion of Copyright on YouTube media is regulated in the Copyright rules and policies in YouTube media which explains regarding 3 (three) maters, namely Fair Use, Making Claims, and Enforcing Copyright Policy. Therefore, it can lock that the resolution of music Copyright disputes has not been carried out optimally and the use of YouTube services may only upload content belonging to itself or with the permission of the owner.
