Abstract

Notary as a public official must have good ethics and can work with honest and accurate. Notary as a public official must also be able to work honestly and can serve the public therefore a Notary should not conduct an online promotion through electronic media and print media. Notary Code of Ethics clearly prohibits a Notary to conduct promotions well through electronic media and print media but apparently until now still found so many violations of the promotional activities. The author in doing this legal writing using the Normative method or Legislation approach and also a real case approach that occurs by searching through the "search engine" in the site google and youtube. The cause of the violation is with the existence of unhealthy competition caused by lack of supervision to Notary which masiih minimal and weakness of moral among Notary itself. The existence of advertising in sites in electronic media is impressed to make it easier for the public to find where the Notary's office is located, but to further till become a business activity where Notary profits to find clients in the online site. The legal consequences for a Notary because doing promotion is to get the distrust of the public for being dishonest and sanction for the Notary who commits a violation to conduct promotion through electronic media and print media in the Notary's Code of Conduct is a disciplinary sanction and civil sanction. / Notaris sebagai seorang pejabat umum wajib memiliki etika yang baik dan dapat bekerja dengan jujur dan cermat. Notaris sebagai pejabat umum juga harus dapat bekerja secara jujur dan dapat melayani masyarakat maka dari itu seorang Notaris tidak boleh melakukan promosi secara online melalui media elektronik maupun media cetak. Kode Etik Notaris jelas melarang seorang Notaris untuk melakukan promosi-promosi secara baik melalui media elektronik maupun media cetak tetapi ternyata sampai saat ini masih ditemukan begitu banyak pelanggaranpelanggaran melakukan kegiatan promosi tersebut. Penulis dalam melakukan penulisan hukum ini menggunakan pendekatan Perundang-undangan dan juga pendekatan kasus yang terjadi secara nyata dengan melakukan pencarian melalui “search engine” di dalam situs google dan youtube. Penyebab terjadinya pelanggarantersebut adalah dengan adanya persaingan tidak sehat yang diakibatkan oleh kurangnya pengawasan terhadap Notaris yang masiih minim dan lemahnya moral di kalangan Notaris itu sendiri. Dengan adanya pemasangan iklan dalam situs-situs di media elektronik memang terkesan memudahkan masyarakat untuk mencari dimana kantor Notaris berada, tapi untuk selanjutnya berujung menjadi kegiatan bisnis dimana Notaris mengambill keuntungan untuk mencari klien di situs online tersebut. Akibat hukum dan sanksi bagi Notaris yang melakukan pelanggaran melakukan promosi melalui media elektronik dan media cetak dalam Kode Etik Notaris adalah sanksi disipliner dan sanksi perdata.
