Abstract

One of the land rights dispute that happen most of the time is double certificate for the same one object. Usually each parties claim to be the owner of the land. The dispute about double certificate for one object is happen not only because the faulty of the applicants of land rights, public officials, Camat and Lurah, but also the faulty since the first registration and issuance of certificates of land rights by Heads of District/City from National Land Agency. The dispute about double certificate is occur in Court Judgement No 639 K/TUN/2015, where Mr. Saman sued the head of the regional office of the National Land Agency of the special capital region of Jakarta, due to the decision No 13/HM/BPN.31-BTL/2014, dated 8 April 2014 related to cancellation of Land Rights No 2307 registered on behalf of Mr Saman. The research method used in making of this thesis is normative legal research with the statue approach and case approach. The Data used are secondary data supported by primary data. Secondary data obtained from the literature and the primary data was obtained through interviews. Data analysis carried out a qualitative analysis which resulted in descriptive analysis. Based from the research, Writer have found out that the revocation of the certificate is caused because of the faulty procedure in the land registration and Lurah and Camat commit fraud in the process buying and selling land and the Court Judgement No 639 K/TUN/2015 has not resolved the problem because there are still two certificate in one land object and the National Land Agency has not yet paid compensation costs for faulty that they made in issuing and revoking the certificate. / Salah satu sengketa tanah yang sering kali terjadi di masyarakat adalah sertipikat ganda. Dimana beberapa pihak mengklaim sebagai pemilik satu objek tanah. Sengketa sertipikat ganda ini bukan saja timbul karena kesalahan dari pelaku atau pemohon hak atas tanah, pejabat umum, Camat dan Lurah, akan tetapi Kepala Kantor Pertanahan Kabupaten/Kota ikut berperan penyembab timbulnya sengketa terutama dalam penerbitan sertifikat hak atas tanah yang berasal dari kegiatan pendaftaran pertama kali. Salah satunya sengketa kepemilikan atas tanah terdapat dalam Putusan Nomor : 639 K/TUN/2015, di mana Saman menggugat Kepala Kantor Wilayah Badan Pertanahan Nasional Provinsi Daerah Khusus Ibukota Jakarta, karena adanya Keputusan Kepala Kantor Wilayah Badan Pertanahan Nasional Provinsi Daerah Khusus Ibukota Jakarta Nomor : 13/HM/BPN.31- BTL/2014 tanggal 8 April 2014 tentang pembatalan Sertipikat Hak Milik Nomor : 2307/Cibubur tercatat atas nama Saman. Metode Penelitian yang digunakan dalam tesis ini adalah penelitian hukum normatif dengan pendekatan undang-undang dan kasus. Data yang digunakan adalah data sekunder didukung dengan data primer. Data sekunder diperoleh dari bahan-bahan kepustakaan dan data primer diperoleh melalui wawancara. Analisis data yang dilakukan secara kualitatif yang menghasilkan deskriptif analisis. Berdasarkan hasil penelitian bahwa pembatalan sertipikat timbul karena adanya kesalahan prosedur dalam kegiatan pendaftaran pertama kalinya yang disebabkan oleh penipuan yang dilakukan Lurah dan Camat dalam proses jual beli tanah dan hasil putusan Nomor : 639 K/TUN/2015 belum menyelesaikan masalah karena masih terdapat dua sertipikat dalam satu bidang tanah serta Kantor Wilayah Badan Pertanahan Nasional tidak mengeluarkan biaya ganti rugi atas kesalahan yang telah diperbuatannya dalam menerbitan dan membatalkan sertipikat tersebut.
