Abstract

Residence is a constitutional right embedded to Indonesian citizens and is also stated in the Constitution of the Republic of Indonesia in 1945. State guarantees that every citizen should have a comfortable, proper, and prosperous residence. The increasing population of Indonesia, particularly in big cities, makes the existence of storey buildings as a place to live are very much needed. Mansions are needed because its effectiveness and efficiency and it can reduce the land use for residential development. Therefore, the law of Republik Indonesia Number 20 Year 2011 Regarding Mansions was established to regulate the use of mansions so it fits for the purpose of the building. However, up until now, there still can be found many violations in the use of residence that are not in accordance with the function of the residence itself. Several units of residential flats are used as business places and it is contrary to the law of Republik Indonesia Number 20 Year 2011 Regarding Mansions. This thesis will examine residential flats that are being used for a business place. This thesis will use normatif juridical method in examining the issue. / Tempat tinggal merupakan hak konstitusional yang melekat pada warga negara Indonesia dan tercantum di dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Negara menjamin setiap warga negara memiliki tempat hunian yang nyaman, layak dan sejahtera. Meningkatnya jumlah penduduk di Indonesia khususnya di kota-kota besar membuat keberadaan bangunan bertingkat sebagai tempat tinggal sangat dibutuhkan. Rumah susun sangat dibutuhkan karena sangat efektif dan efisien serta dapat mengurangi penggunaan lahan yang dibutuhkan untuk pembangunan hunian. Oleh karena itu, Undang-Undang Republik Indonesia Nomor 20 Tahun 2011 tentang Rumah Susun dibentuk untuk mengatur pemanfaatan rumah susun agar sesuai dengan fungsi pendirian bangunan nya. Namun, hingga saat ini masih ditemukan banyak pelanggaran dalam pemanfaatan rumah susun yang tidak sesuai dengan fungsi pemanfaatan rumah susun. Beberapa unit satuan rumah susun hunian digunakan sebagai tempat usaha dan hal tersebut sangat bertentangan dengan Undang-Undang Republik Indonesia Nomor 20 Tahun 2011 tentang Rumah Susun. Tesis ini akan membahas mengenai rumah susun hunian yang digunakan sebagai tempat usaha. Tesis ini akan menggunakan metode penelitian yuridis normatif dalam mengkaji permasalahan yang akan di bahas.
