Abstract

Penelitian ini membahas mengenai pemotongan upah pekerja yang dilakukan pada masa pandemi Covid-19 yang ditinjau dari Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerajaan dan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Penelitian ini menggunakan tipe penelitian Yuridis Normatif yang dalam pengolahan bahan hukum dilakukan melalui studi pustaka. Penelitian ini bertujuan untuk menganalisis mengenai diperbolehkannya pemotongan upah pekerja yang dilakukan pada masa pandemi Covid-19. Hasil penelitian menunjukan bahwa pengusaha diperbolehkan melakukan pemotongan upah pekerja pada masa pandemi Covid-19 apabila pemotongan upah tersebut sesuai dengan ketentuan Peraturan Pemerintah Nomor 36 Tahun 2021 tentang pengupahan serta tidak berada di bawah upah minimum kota/kabupaten sesuai dengan ketentuan dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. / This study discusses the deduction of workers wages during the Covid-19 pandemic of Law Number 13 of 2003 concerning Manpower and Law Number 11 of 2020 concerning Job Creation. This study uses a type of Normative Juridical research in which the processing of legal materials is carried out through literature study. This study aims to analyze the permissibility of deductions from workers wages during the Covid-19 pandemic. The results of the study show that employers are allowed to cut workers wages during the Covid-19 pandemic if the wage cuts are in accordance with the provisions of Government Regulation Number 36 of 2021 concerning wages and are not below the city or district minimum wage in accordance with the provisions of Law Number 13 2003 concerning Manpower and Law Number 11 of 2020 concerning Job Creation.
