Abstract

Yayasan adalah badan usaha yang berbentuk badan hukum. Yayasan mempunyai tujuan di bidang sosial sesuai dengan pasal 1 angka 1 UU 16 tahun 2001 yang disempurnakan dalam UU 28 tahun 2004 tentang Yayasan. Yayasan sama seperti halnya dengan badan usaha lain yang mempunyai kekayaan sendiri. Kekayaan bisa didapat melalui berbagai cara salah satunya adalah penghibahan. Terjadi kasus permintaan harta kekayaan yayasan di Kabupaten Mojokerto tepatnya di Yayasan Kerukunan Pentakosta Dadapan yang kekayaannya diminta oleh salah satu ahli waris dari penghibah dan merupakan pendiri yayasan tersebut. Tugas akhir ini bertujuan untuk memenuhi salah satu persyaratan akademis dalam memperoleh gelar Sarjana Hukum pada Universitas Pelita Harapan Kampus Surabaya, untuk lebih memahami tentang kekayaan yayasan yang diperoleh dari pemerintah, lebih memahami tentang permintaan kekayaan yayasan diperbolehkan atau tidak dari segi pandang Undang-Undang Yayasan, lebih memahami tentang pelaksanaan dan penatausahaan hibah dan bantuan sosial dari pemerintah. Kesimpulan dari penelitian ini adalah kekayaan tidak bisa dibagikan kepada ahli waris karena sudah menjadi hak milik dari Yayasan Kerukunan Pentakosta Dadapan serta tidak bisa dibagikan secara umum. / Foundation is a business entity in the form of a legal entity. Foundations have a goal in the social sector in accordance with Article 1 number 1 UU no. 16 of 2001 which was perfected in UU no. 28 of 2004 concerning Foundations. Foundations are the same as other business entities that have their own wealth. Wealth can be obtained through various ways, one of which is donations. There was a case of requesting a foundation's assets in Mojokerto Regency, precisely at the Kerukunan Pentaskosta Dadapan Foundation whose wealth was requested by one of the heirs of the grantor and was the founder of the foundation. This final project aims to fulfill one of the academic requirements in obtaining a Law Degree at Pelita Harapan University, Surabaya Campus, to understand more about foundation wealth obtained from the government, to understand more about whether or not requests for foundation assets are allowed from the perspective of the Foundation Law, better understand about the implementation and administration of grants and social assistance from the government. The conclusion of this study is that wealth cannot be distributed to heirs because it has become the property of the Kerukunan Pentakosta Dadapan Foundation and cannot be distributed in general.
