Abstract

Penelitian ini membahas mengenai dasar pertimbangan hakim dalam putusan No.372/Pid.B/2020/Pn.Jkt.Utr dan Putusan No.415/Pid.B/2017/Pn.Bta terkait kasus penganiayaan dengan rencana. Penelitian ini menggunakan tipe penelitian Yuridis Normatif dimana pengolahan bahan hukum dilakukan secara studi pustaka, dengan pendekatan masalah yang digunakan adalah statute approach, conceptual approach, comparative approach, dan case approach. Penelitian ini bertujuan untuk mengetahui dasar pertimbangan hakim serta penerapan sanksi yang diberikan dalam putusan No. 372/Pid.B/2020/PN. Jkt Utr sehingga terjadi perbedaan dengan putusan No. 415/Pid.B/2017/PN.Bta. Indonesia menggunakan sistem hukum civil law yang mengenal adanya yurisprudensi. Yurisprudensi berperan sebagai petunjuk bagi hakim dalam mebuat suatu putusan. Kebebasan hakim dalam membuat suatu putusan dapat mengakibatkan disparitas putusan yaitu perbedaan penjatuhan pidana pada pelaku kejahatan yang sama. Disparitas putusan dapat terjadi karena adanya berbagai faktor yang berbeda pada tiap kasus./This study discusses the basic considerations of the judge in the decision No.372/Pid.B/2020/Pn.Jkt.Utr and Decision No.415/Pid.B/2017/Pn.Bta related to the case of planned persecution. This study uses a normative juridical research type where the processing of legal materials is carried out in a literature study, with the problem approach used is the statute approach, conceptual approach, comparative approach, and case approach. This study aims to determine the basis of the judge's considerations and the application of the sanctions given in the decision no. 372/Pid.B/2020/PN. Jkt Utr so that there is a difference with the decision no. 415/Pid.B/2017/PN.Bta. Indonesia uses a civil law legal system that recognizes jurisprudence. Jurisprudence acts as a guide for judges in making a decision. The judge's freedom in making a decision can result in disparity in decisions, namely differences in criminal penalties for the same criminal. Disparity in decisions can occur due to various factors that are different in each case.
