Abstract

Undang – Undang Nomor 32 Tahun 2009 Tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH) mengenal berbagai jenis instrumen pencegahan pencemaran dan/atau kerusakan lingkungan hidup, salah satunya adalah perizinan. Beleid ini mengenal 2 (dua) jenis izin yakni Izin Lingkungan dan Izin Usaha, korelasi diantaranya adalah bahwa izin lingkungan merupakan syarat untuk mendapatkan izin usaha dan/atau kegiatan. UUPPLH adalah salah satu dari banyaknya undang-undang yang masuk kedalam daftar penataan dan perubahan yang dituangkan ke dalam Undang – Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja (UU Cipta Kerja) ditindaklanjuti dengan peraturan pemerintah pelaksanaan yaitu Peraturan Pemerintah Nomor 22 Tahun 2021 tentang Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup (PP P3LH). Pada UU Cipta Kerja juncto PP P3LH ini, terminologi Izin Lingkungan dihapuskan, muncul terminologi baru dengan nama Persetujuan Lingkungan. Penelitian melalui metode Yuridis – Normatif dengan pendekatan masalah secara Statue Approach dan Comparative Approach ini betujuan untuk menelaah dampak positif yang ditimbulkan dari dirubahnya pengaturan perizinan ini / Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH) recognizes various types of instruments for preventing pollution and/or environmental damage, one of them is licensing. This regulation recognizes 2 (two) types of lisence which are the Environmental and Business lisence, the correlation is that environmental lisence are a requirement to obtain business and/or activity lisence. UUPPLH is one of the many laws that are included in the list of arrangements and changes as outlined in Law Number 11 of 2020 about Cipta Kerja (UU Cipta Kerja) followed up with implementing government regulations, namely Government Regulation Number 22 of 2021 concerning the Implementation of Protection and Environmental Management (PP P3LH). In the UU Cipta Kerja juncto PP P3LH, the term Environmental lisence is abolished, which then a new terminology appears with the name Environmental Approval. This research using the Juridical – Normative method with a Statue Approach and Comparative Approach, aims to examine the positive impact of changing environmental management licensing arrangements.
