Abstract

Penelitian ini membahas mengenai maraknya pekerjaan influencer akibat adanya kemajuan teknologi di Indonesia. Pekerjaan Influencer ini tidak hanya digandrungi oleh para remaja dan orang dewasa saja, tetapi juga para orang tua yang menjadikan anak mereka influencer anak karena selain mudah dan sejalan dengan minat, bakat, dan hobi anak mereka, pekerjaan ini turut mendatangkan keuntungan berupa uang. Pada dasarnya menurut UU Ketenagakerjaan, anak tidak boleh bekerja karena selain dapat mengganggu perkembangan dan kesehatan fisik, mental, dan sosial anak, hal ini juga dapat menimbulkan potensi anak untuk dieksploitasi secara ekonomi yang dilarang dalam UU Perlindungan Anak. Tujuan dari penelitian adalah untuk mengetahui aturan hukum mengenai pekerja influencer anak serta hak – hak pekerja anak dalam UU Perlindungan Anak jo. UU Ketenagakerjaan dan sanksi bagi pelanggar hak-hak anak. Tipe penelitian yang digunakan adalah tipe penelitian Yuridis Normatif-Dogmatik dengan menggunakan pendekatan konsep (Conceptual Approach), pendekatan perundang-undangan (Statute Approach), dan pendekatan Kasus (Case Approach). Hasil penelitian ini menunjukan bahwa, orang tua atau pengasuh yang mempekerjakan seorang anak menjadi influencer anak, dalam hal ini TM yang mengkaryakan ‘A’ sebagai influencer anak, terbukti telah melakukan eksploitasi ekonomi sebagaimana yang dituduhkan kepadanya. Selain terdapat pelanggaran atas usia anak yang boleh dipekerjakan, TM juga telah melanggar hak ‘A’ dalam UU Perlindungan Anak demi mendapatkan keuntungan untuk dirinya sendiri. / This literature is mainly discussing about the rise of new working title as influencer due to the technology advancement in Indonesia. Influencer work isn’t only treasured by teenagers and adults, but parents nowadays who turn their children into child influencer because beside of the reasoning an easy entry industry combined with the alignment of interests, talents, and hobbies of their children, somewhat this particular line of work incur financial benefits. Basicaly, based on enacted Labor Law, children are prohibited to have occupations because besides being able to interfere with the physical, mental, and social development and health of children, this configuration impacts could aggravate that lead to the potential exploited child matter in regards with monetary advantages which is outlawed in the Child Protection Act. The purpose of the research is to find out about the legal rules regarding child influencer workers and the rights of child labor that has been enacted in the Child Protection Law jo. Labor Law and sanctions for violators of children's rights. This research is conducted after Normative-Dogmatic Juridical with Conceptual approach, Statute Approach, and Case Approach. The result of this research shows that, parents or care giver who employs a child to entitled as child influencer, in this study of TM who employs ‘A’ as a child influencer, found guilty from proven-based concept law as alleged to carry economical exploitation towards her. Besides, there’s a violation conducted for the regard of age wise children labor law, TM also violated ‘A’ ‘s right which mentioned in Child Protection for the benefit of herself.
