Abstract

Skripsi ini akan membahas mengenai perlindungan yang diberikan Hak Cipta atas sebuah karya seni yang dipergunakan sebagai merek. Diawali dengan pembahasan mengenai karya seni dan pengklasifikasiannya, kemudian dibahas mengenai perlindungan hak cipta atas karya seni tersebut. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif. Yuridis normatif yang merupakan penelitian berdasarkan pada peraturan perundang – undangan yang berlaku dan literatur – literatur serta norma– norma yang berkaitan dengan pokok bahasan, dengan pendekatan masalah yang digunakan ialah (statute approach) dan (conceptual approach). Statute approach adalah peraturan yang digunakan dengan membahas peraturan perundang- undangan yang berlaku berkaitan dengan permasalahan yang ditangani. Sedangkan conceptual approach merupakan teori dari ahli hukum, literature – literature dan bacaan lainnya yang sesuai dengan kasus yang diambil. Karya seni telah mendapatkan perlindungan hak cipta atasnya maka ketentuan mengenai hak cipta berlaku atasnya. Terkait dengan penggunaannya sebagai Merek maka perlu dilakukan pengalihan hak cipta terlebih dahulu dari pencipta kepada pihak yang akan mempergunakan karya tersebut. Terkait dengan perlindungannya skripsi ini akan membahas teori yang dipaparkan yang nantinya akan dikaitkan dengan kasus almarhum. Henk Ngantung. Henk Ngantung merupakan seorang seniman, pembuat sketsa patung selamat dating di Bundaran Hotel Indonesia. Gambar sketsa alm. Henk Ngantung dipergunakan sebagai merek tanpa izin oleh salah satu pusat perbelanjaan ternama di Jakarta yang terletak di Bundaran Hotel Indonesia./This thesis will discuss the protection provided by Copyright for a work of art that is used as a brand. It begins with a discussion of works of art and their classification, then discusses the Copyright Protection of these works of art. The research method used in this research is normative juridical. Normative juridical which is research based on applicable laws and regulations and literature and norms related to the subject matter, Artwork has received Copyright Protection on it, the provisions regarding Copyright apply to it. In relation to its use as a Mark, it is necessary to transfer the Copyright in advance from the Author to the party who will use the work. Regarding his protection, this thesis will discuss the theory presented which will later be linked to the case of the deceased. Henk Hang. Henk Nuntung is an artist, sketcher of a welcome sculpture at the Hotel Indonesia Roundabout. The sketch of the late Henk Nuntung was used as atrademark without permission by a well-known shopping center in Jakarta, which is located at the Hotel Indonesia Roundabout
