Abstract

Penelitian ini bertujuan untuk menemukan secara pasti tentang perlindungan hukum bagi buron yang ditembak mati oleh aparat kepolisian dalam perspektif Hak Asasi Manusia. Dalam Undang-Undang Nomor 39 Tahun 1999 Pasal yang ke-1 ayat 1 sudah tertulis bahwa Hak Asasi Manusia merupakan hak yang melekat pada setiap manusia yang wajib dihormati dan dijunjung tinggi dan tentunya dilindungi oleh negara dan juga setiap orang. Tugas akhir ini bertujuan untuk mengetahui dan memahami aturan-aturan hukum mengenai pelanggaran terhadap Hak Asasi Manusia seseorang. Tipe penelitian yang digunakan dalam skripsi ini adalah tipe penelitian Yuridis Normatif-Dogmatik dengan menggunakan pendekatan perundang-undangan (Statue Approach), pendekatan konsep (Conceptual Approach), dan pendekatan kasus (Case Approach) Hasil analisis dalam tugas akhir ini menunjukkan, bahwa pelanggaran atas Hak Asasi Manusia yang dilakukan oleh aparat kepolisian mengakibatkan korban meninggal dunia. Oleh sebab itu aparat penegak hukum negara wajib menindak hal tersebut yang telah dilakukan oleh aparat kepolisian, agar tugas dari kepolisian sesuai dengan yang tertulis di dalam Pasal 13 Undang-Undang No. 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia. = In the context of human rights, the goal of this study is to learn definitively about legal protection for fugitives shot dead by police officers. Human Rights are inherent in every human being and must be respected, upheld, and of course,protected by the state as well as everyone, according to Article 1 paragraph 1 of Law Number 39 of 1999. The goal of this final project is to learn and understand the legal laws governing violations of a person's human rights. This thesis employs a normative-dogmatic legal research method that includes a statutory approach (Statue Approach), a concept approach (Conceptual Approach), and a case approach (Case Approach). According to the findings of this final project's analysis, police violations of human rights resulted in the death of the victim. As a result, state law enforcement officers are required to act on this matter that has been solved by the police, in order for the police to carry out their duties in accordance with Article 13 of Law No. 2 of 2002 concerning the Indonesian National Police.
