Abstract

Perkembangan akan teknologi membuat banyak perubahan dalam berbagai bidang serta berbagai macam hal. Salah satunya pembuatan tanda tangan yang biasanya dilakukan secara konvensional bisa dikembangkan secara elektronik. Aplikasi Privy.ID merupakan aplikasi yang tersertifikasi untuk pembuatan tanda tangan digital. Salah satu bentuk tanda tangan elektronik ialah tanda tangan digital. Tanda tangan biasa dan tanda tangan elektronik pada dasarnya merupakan hal yang sama akan tetapi memiliki bentuk yang berbeda. Tanda tangan biasa dituangkan dalam bentuk tanda tangan konvensional akan tetapi tanda tangan elektronik dituangkan dalam bentuk tanda tangan digital. Dalam pembuktiannya tanda tangan biasa dan elektronik memiliki kekuatan hukum yang sama. Juga sama – sama memiliki sifat keterikatan terhadap pihak yang terkait. Hal tersebut juga berlaku untuk tanda tangan digital dalam aplikasi Privy.ID yang dapat digunakan untuk bertransaksi serta memiliki kekuatan hukum yang sah sama dengan tanda tangan konvensional yang berlandaskan dengan peraturan yang ada dalam Pasal 12 UU ITE dan Pasal 53 PP 82/2012. / The revolution of technology makes many changes in various things. One of them is the development of conventional signatures into electronic signatures. Privy.ID is an certified application for digital signature creation. One of the electronic signature is a digital signature. Conventional signatures and electronic signatures basically is a same thing but have different forms. Conventional signature is directly written on a paper, but an electronic signature is written on a digital signature. In the proof, conventional and electronic signatures have the same legal force. They also have the same nature of attachment to the parties involved. This also applies to digital signatures on Privy.ID which can be used for transactions and have the same legal force as conventional signatures based on the regulations contained in Pasal 12 UU ITE and Pasal 53 PP 82/2012
