Abstract

Pada skripsi ini membahas mengenai kasus pencemaran lingkungan hidup yang terjadi di lokasi hukum (locus delicti) Pengadilan Negeri Demak. Pencemaran lingkungan hidup yang disebabkan olehkegiatan produksiPT. SBCON PRATAMA Terdakwa, yaitu Evans Winata sebelumnya bekerja pada PT. SB CON PRATAMA dengan jaatan sebagai direktur keuangan dan sumber daya manusia. Terdakwa dihadapkan dengan tuntutan Penuntut Umum yakni, melakukan pengelolaan limbah B3 tanpa izin instansi terkait, menghasilkan limbah B3 dan tidak melakukan pengelolaan, serta melakukan dumping limbah ke media lingkungan hidup tanpa izin dengan nomor registrasi perkara PDM-10/O.3.31/Euh.2/03/2018 tanggal 27 Maret 2018. Tipe penelitian yang digunakan adalah yuridisnormatif melalui pendekatan Statute Approach, Conceptual Approach, dan, Case Approach. Dalam penelitian ini terdakwa dinyatakan tidak terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana sebagaimana yang didakwakan dalam dakwaan Pertama Primair, dakwaan Pertama Subsidair maupun dakwaan Kedua. / This thesis discusses the case of environmental pollution that occurred in the legal location (locus delicti) of the Demak District Court. Environmental pollution caused by the production activities of PT. SB CON PRATAMA The defendant, namely Evans Winata previously worked at PT. SB CON PRATAMA with the position as director of finance and human resources. The defendant was faced with the demands of the Public Prosecutor, namely, to manage B3 waste without a permit from the relevant agency, to produce B3 waste and not to manage it, and to dump waste into environmental media without a permit with case registration number PDM-10/O.3.31/Euh.2 /03/2018 dated 27 March 2018.The type of research used is normative juridical through the Statute Approach, Conceptual Approach, and Case Approach. In this study, the defendant was declared not legally and convincingly proven guilty of committing a criminal act as charged in the First Primary Charge, the First Subsidiary Charge and the Second Charge.
