Abstract

One of the Indonesian government's efforts to fight COVID-19 is to hold vaccinations for all Indonesians. However, these efforts are hampered by the circulation of fake COVID-19 vaccines in various countries. Therefore, this study was written with the aim of knowing the regulations governing fake COVID-19 vaccines, how to distribute the COVID-19 vaccine, and the responsibilities that can be imposed on the perpetrators of making or distributing fake COVID-19 vaccines. This study uses normative legal research methods with the type of data used in this study is primary data and is supported by secondary data. The result of this study is that the responsibility for circulating fake Covid vaccines is borne by everyone who is the culprit. Moreover, so far there has been no regulation regarding fake COVID-19 vaccines, so it only refers to existing regulations. In addition, the existing regulations only regulate the side effects of the Covid vaccine that has been used. Furthermore, the government has responsibilities that are divided into two things, the circulation of fake vaccines through one door and the circulation of fake vaccines that the Government neglects to supervise (in other cases not through one door). The government can be held responsible for its negligence, while the other party is responsible for the counterfeiting of fake COVID-19 vaccines. The conclusion obtained is that there is a need for regulations that regulate comprehensively and can implement prevention of the circulation of fake COVID-19 vaccines in Indonesia followed by the responsibility of the parties involved. In addition, there is a need for a special institution to oversee this fake COVID-19 vaccine, even though in Indonesia there is still no indication. The sources of this writing are statutory regulations, books, and the results of interviews with various sources.
