Abstract

"Penanganan tindak pidana korporasi mengalami kendala akibat KUHP maupun KUHAP belum mengakui Korporasi sebagai bagian dari subjek hukum pidana, atas hal inilah kemudian Mahkamah Agung menerbitkan Peraturan Mahkamah Agung Nomor 13 Tahun 2016 dalam mengatasi kendala penanggulangan tindak pidana korporasi tersebut. Sehingga ada pertanyaan mengemuka yaitu bagaimana kedudukan Perma No 13 Tahun 2016 dalam mengisi kekosongan hukum tata cara penanganan tindak pidana korporasi dan bagaimana peran Perma No 13 Tahun 2016 dalam menanganani tindak pidana korporasi. Metode penelitian hukum normatif digunakan untuk menjawab permasalah tersebut. Secara konstitusional Perma 13 Tahun 2016 merupakan bagian dari peraturan perundang-undangan sebagaimana yang diatur dalam penjelasan Pasal 79 Undang-Undang tentang Mahkamah Agung dimana tujuannya untuk mengisi kekosongan hukum yang belum diatur dalam undang-undang dan secara substansi khusus membahas hukum acara saja. Selain itu hadirnya Perma No 13 Tahun 2016 sendiri memberikan peran penting dimana mempermudah penegak hukum dalam menjerat korporasi yang terlibat dalam tindak pidana, akan tetapi terdapat beberapa permasalahan yakni di beberapa Pasal yang diatur dalam Perma 13 Tahun 2016 berpotensi melanggar hak konstitusional subjek hukum didalamnya, sehingga hal ini menimbulkan problem keadilan dimana dalam melaksanakan Perma No 13 Tahun 2016 Mahkamah Agung memiliki tiga kewenangana sekaligus, yakni sebagai pembuat, pelaksana dan penguji dari Perma No 13 Tahun 2016 itu sendiri. Pemberlakuan Perma No 13 Tahun 2016 sendiri tidak boleh jalankan berlarut-larut, perlu adanya pembaharuan di dalam KUHP maupun KUHAP. Kata Kunci: Perma No 13 Tahun 2016, Kekosongan Hukum, Penanganan Tindak Pidana Korporasi" / "The process of overcoming corporate injustice crime has got stumbled due to the fact that the Penal code or the Criminal Code Procedure has not admitted yet as a legal subject. In regard to this matter, Supreme Court has released regulation of Supreme Court number 13 year 2016 for solving the constraint over fighting against the case of corporate injustice crime. Therefore, some inquiries emerge how the position of regulation of Supreme court Number 13 year 2016 is, in accordance with the filling of absence of procedures in overcoming corporate injustice crime and how the role of regulation of Supreme Court Number 13 year 2016 in overcoming corporate injustice crime is. The method of the research of normative law is used to answer for the matter. Constitutionally, The regulation of Supreme Court Number 13 year 2016 is a part of regulation of law as being ruled in the article 79 of Indonesia law about Supreme Court in which its purpose for filling the absence of regulation, that has not been regulated yet by the law and to such an extent, the chapter of Supreme Court Number 13 year 2016 is only about law of procedure. In the other hand, the present of regulation of Supreme Court Number 13 year 2016 has significance role to make it esier for law enforcement agency to entagele with that article, however there are some problems in regulation of Supreme Court Number 13 year 2016. There have potential violations against the right of legal subject. Therefore these lead to the problem of justice in which the supreme court enforcing the regulation of Supreme Court Number 13 year 2016 has three authority at once those are (i.e ) as a legislator, excecutor and examiner of the regulation. Putting into effect of regulation of Supreme Court Number 13 Year 2016 is not allowed to be endless, it needs to reform in the Penal code or the Criminal Code Procedure.
