Abstract
Nowadays, audio recording are commonly used as one of many evidences in Indonesian’s court, especially in criminal cases. The government actually has regulate about audio recording as an evidence in the Information and Electronic Transaction Act. This Act already mentioned the requirements that audio recording could be a legalized evidence. One of the requirements is that the
evidence should be checked by a digital forensics expert. The method used in this thesis is the juridicial-normative method with Acts and cases approach. As seen in
the cases that been used in this thesis, which is defamation, sexual abuse and violence, and also fraud cases, the Judge still accept and consider the audio
recording evidence although none of them has been checked by a digital forensics expert. It shows that Indonesian’s Law hasn’t been enforced in practice, so the Judge needs more precision in accepting and considering evidence.
