Abstract

Penelitian ini bertujuan untuk mengetahui bentuk potensi eksploitasi anak dalam profesi bintang iklan yang diperankan oleh anak berdasarkan Undang Undang yang berlaku dan untuk mengetahui perlindungan hukum terhadap anak yang berprofesi sebagai bintang iklan ditinjau dari Undang Undang Perlindungan Anak. Metode yang digunakan dalam tesis ini adalah yuridis normatif, yaitu jenis penelitian hukum yang menggunakan data primer dan sekunder yang dilakukan dengan melakukan penelitian kepustakaan, penelitian yang mengacu pada norma-norma yang terdapat dalam peraturan perundang-undangan yang berkaitan dengan permasalahan yang dianalisis oleh penulis dalam penelitian ini sehingga dapat menghasilkan kesimpulan. Profesi anak sebagai bintang iklan dapat berpotensi sebagai bentuk eksploitasi anak secara ekonomi, apabila anak terlalu dini untuk bekerja sebagai bintang iklan di dunia hiburan yang berpotensi melanggar hak-hak yang diatur dalam Undang Undang Perlindungan Anak, seperti hak untuk dapat hidup dan tumbuh secara wajar, hak atas pendidikan yang baik dan hak atas istirahat dan lain-lain. Sebagaimana telah diatur pada pasal-pasal dalam Undang Undang Perlindungan Anak Nomor 23 Tahun 2002 yang coba disempurnakan dengan Undang Undang Nomor 35 Tahun Tahun 2014 tentang Perubahan atas Undang Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Aktivitas sebagai bintang iklan didasarkan pada pemanfaatan anak secara berlebihan yang dilakukan oleh orang tua atau walinya serta pengusaha untuk memanfaatkan anak dan hak-hak anak yang dilanggar karena dipekerjakan di dunia hiburan yang didominasi oleh orang dewasa yang memberikan beberapa dampak negatif pada anak-anak. Pengaturan mengenai perlindungan anak diatur secara khusus dengan diterbitkannya Undang Undang Perlindungan Anak sebagai pedoman, meskipun perangkat hukum kita masih tergolong lemah namun Pemerintah berusaha untuk mencapai tujuan agar semakin terjaminnya pemenuhan hak-hak anak tanpa perlakuan diskriminatif terhadap anak./ The study aims to find out the potential form of child exploitation in the commercial star profession played by children based on applicable laws and to find out the protection of the law for children who work as commercial star reviewed from child protection law. The method used in this thesis is a juridis normative, which is a type of legal research that uses primary and secondary data which is carried out by conducting library research, research that refers to norms contained in regulations relating to the problems analyzed by the author in this research so that it can produce conclusions. The child profession as a commercial star can potentially as a form of exploitation of child economically, because the child is too early to work as a star in the entertainment world that has the potential to violate rights as stipulated in child protection laws, such as the right to be able to live and grow naturally, the right to have a good education and right to rest, etc. Which has been regulated in articles in the Child Protection Law Number 23 of 2002 that has tried to be perfected to Law Number 35 of 2014 on the Amendment of the Law Number 23 of 2002 on Child Protection. The activity as a commercial star is based on excessive utilization of children committed by parents or their legal guards also entrepreneurs to take advantage of the child and children's rights violated because they are employed in the entertainment world dominated by adults who provide some of negative impacts on children. The rules of child protection are specifically regulated by the issuance of the Child Protection Law as a guideline even though our legal instruments are still relatively weak but the government tried to fulfill goals to be increasingly guaranteed to fulfill the rights of children without discriminatory treatment to the children.
