Abstract

Perkembangan zaman sangat mempengaruhi teknologi khususnya pemanfaatan teknologi internet dan komunikasi yang mendorong perkembangan bisnis daring seperti e-commerce. Karena adanya Pandemi COVID-19, gaya hidup masyarakat yang beralih dan mengandalkan belanja di e-commerce. Perekonomian dunia ini mengalami perubahan yang sangat besar yang disebabkan oleh berkembangnya kegiatan finansial, investasi, produksi dan perdagangan yang mendukung tingkat ketergantungan antar negara yang menimbulkan persaingan yang ketat dan mendorong ke arah globalisasi. Globalisasi telah menggabungkan ekonomi dunia, sehingga praktik bisnis dan batas antar negara seakan-akan dianggap tidak ada. Dengan adanya invensi e-commerce, dapat mengefektifkan, mempermudah dan mengefisiensikan waktu dan tempat sehingga transaksi jual beli dapat dilakukan kapan dan dimana saja. Namun hal ini juga dapat dijadikan pedang bermata dua, karena banyak nya kemungkinan kejahatan yang terjadi dalam transaksi e-commerce seperti salah satu nya adalah kebocoran data. Beberapa tahun terakhir telah terjadi beberapa kasus kebocoran data, namun belum ada penyelesaian karena belum ada hukum khusus perlindungan data pribadi. Dalam penelitian tesis ini membahas mengenai kedudukan hukum data pribadi dan perbandingan perlindungan hukum atas data pribadi bagi pembeli yang menggunakan e-commerce. / The development of technology, especially on the use of internet and communication technology which encourages the development of online businesses such as e-commerce. Due to the COVID-19 pandemic, people's lifestyles are switching and relying on shopping on e-commerce. The world economy is undergoing enormous changes due to the development of financial, investment, production and trade activities that support the level of interdependence between countries that creates intense competition and pushes towards globalization. Globalization has merged the world economy, so that business practices and borders between countries seem to be considered non-existent. With the invention of e-commerce, buying and selling transactions can be carried out anytime and anywhere. However, this can also be used as a double-edged sword, because there are many possible crimes that occur in e-commerce transactions, such as data leakage. The last few years there have been several cases of data leakage, but there has been no resolution because there is no specific law for the protection of personal data. In this thesis research discusses the legal position of personal data and the comparison of legal protection of personal data for buyers who use e-commerce.
