Abstract

Pengembang Apartemen membangun bangunan Apartemen dan melakukan penjualan yang bertujuan untuk dibeli oleh pembeli unit yang disebut konsumen. Pembeli unit yang disebut konsumen membeli unit Apartemen dengan itikad dengan tujuan untuk ditinggali oleh pembeli ataupun untuk instrument investasi. Dengan perkembangan zaman, pembangunan apartemen banyak yang tidak selesai yang disebut mangkrak. Pembangunan apartemen yang mangkrak mengakibatkan kerugian bagi pembeli unit apartemen baik secara materil maupun waktu. Apartemen yang mangkrak merupakan bentuk wanprestasi dan perbuatan melawan hukum dari pengembang kepada pembeli unit apartemen. Penyelesaian sengketa akibat tindakan yang dilakukan pengembang dengan mengajukan gugatan ke pengadilan maupun mengajukan pelaporan kepada instansi penegak hukum dalam hal ini kepolisian. Penyelesaian sengketa ke pengadilan merupakan hak bagi setiap warga negara yang mencari keadilan atas permasalahan yang dihadapi oleh warga negara dalam hal ini pembeli unit. Putusan pengadilan terkadang tidak mencerminkan keadilan karena hakim sering melihat kepada hukum formal bukan esensi hukum materi. Putusan pengadilan yang terkadang kurang memenuhi unsur keadilan bagi pembeli unit karena putusan pengadilan kurang mengakomodir hak keadilan yang seharusnya menjadi hak pembeli unit. Peraturan regulasi yang ada untuk mengakomodir mengenai Apartemen Undang-Undang Nomor 20 Tahun 2011 tentang Rumah Susun, Undang-Undang Nomor 5 Tahun 1999 tentang Perlindungan Konsumen dan Perjanjian kurang cukup untuk memberikan efek jera bagi para pengembang yang mangkrak atau ingkar janji atas perjanjian yang dibuat./ Apartment developers build apartment buildings and make sales that aim to be purchased by unit buyers called consumers. Buyers of units called consumers buy apartment units with the intention of being inhabited by buyers or for investment instruments. With the development of the times, many apartment constructions are not finished, which is called stalled. The stalled construction of apartments results in losses for apartment unit buyers, both materially and time. A stalled apartment is a form of default and an unlawful act from the developer to the buyer of the apartment unit. Settlement of disputes due to actions taken by the developer by filing a lawsuit to the court or submitting a report to law enforcement agencies in this case the police. Settlement of disputes to court is the right of every citizen who seeks justice for the problems faced by citizens, in this case the buyer of the unit. Court decisions sometimes do not reflect justice because judges often look at formal law rather than the essence of material law. Court decisions sometimes do not fulfill the element of justice for unit buyers because court decisions do not accommodate the rights of justice that should be the rights of unit buyers. The existing regulations to accommodate apartments, Law Number 20 of 2011 concerning Flats, Law Number 5 of 1999 concerning Consumer Protection and Agreements are not sufficient to provide a deterrent effect for developers who fail or break their promises of agreements made.
