Abstract

The formulation of Government Regulation Number 56 of 2021 concerning management of Song and/or music copyright royalties has created a public debate. There are several groups of people who agree and disagree with the formulation of government regulation number 56 of 2021 concerning management of royalties for song and/or music copyrights. Furthermore, it is stipulated in the government regulation that if someone uses another person’s song and/or music for commercial purposes in the form of public services, they are required to pay royalties. Moreover, the purpose of this research is to obtain information and solve legal problems regarding to the impact of copyright protection on the economic rights of song and/or music creators based on government regulation number 56 of 2021 concerning the management of copyright royalties for songs and/or music. In this research, the author uses normative empirical research, in which it will analyze the use of songs by restaurant business owners based on government regulation number 56 of 2021 concerning management of songs and/or music copyright royalties. Furthermore, copyright protection which has been regulated in law number 28 of 2014 concerning copyright is very comprehensive because it includes the regulation of moral and economic rights of the creator and the types of works have been regulated in article 2 of berne convention. The use of songs by restaurant commercial interests is a violation of the economic rights of song and/or music creators based on law number 28 of 2014 concerning copyright and government regulation number 56 of 2021 concerning management of royalties for songs and/or music copyrights. Copyright legal protection is carried out based on declarative principles and automatic protection, so that copyright protection must be provided directly without any conditions.
