Abstract

Peraturan Pemerintah Nomor 24 tahun 2016 tentang Perubahan Atas Peraturan Pemerintah Nomor 37 tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah (selanjutnya disebut PPAT) adalah pejabat umum yang diberi kewenangan untuk membuat akta-akta otentik mengenai perbuatan hukum tertentu mengenai hak atas tanah atau Hak Milik Atas Satuan Rumah Susun. Sebagai pejabat umum, PPAT diberi tugas dan wewenang membantu kepala Kantor Pertanahan dalam melaksanakan pendaftaran tanah seperti pembuatan Akta Jual Beli (selanjutnya disebut AJB). Dalam Putusan Peninjauan Kembali Nomor : 909 PK/Pdt/2020 tertanggal 16 Desember 2020 telah digugat AJB berdasarkan kuasa dalam Akta Pengikatan Jual Beli (PPJB). Dalam gugatannya, Penjual mempunyai seorang Istri akan tetapi dalam pembuktiannya Kartu Tanda Penduduk (KTP) tidak menikah dan Kartu Keluarga (KK) hanya sendiri. Sebagai PPAT bertanggung jawab untuk mengecek syarat berkas secara formal tetapi PPAT tidak memiliki kewajiban mengecek kebenaran materiil seperti Kartu Tanda Penduduk (KTP). Telah beralihnya hak atas tanah Pembeli sudah sesuai dengan Pasal 19 ayat (1) juncto ayat (2) huruf c juncto Pasal 37 Ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah merupakan bukti kuat adanya penghapusan hak milik dan sahnya pengalihan tanah dan dilakukan sesuai prosedur jual beli. Oleh karena itu, Penulis tertarik untuk meninjau permasalahan ini untuk mengetahui bagaimana tanggung jawab PPAT terhadap pembuatan Akta Jual Beli (AJB) untuk peralihan hak atas tanah kepada pembeli dan bagaimana kekuatan Akta Jual Beli (AJB) sebagai bukti pembayaran peralihan hak atas tanah yang sah kepada Pembeli. Dalam melakukan penelitian ini, metode penelitian yang digunakan Penulis adalah penelitian kualitatif dengan jenis penelitian yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan, pendekatan kasus dan pendekatan konseptual. / Government Regulation Number 24 of 2016 concerning Amendments to Government Regulation Number 37 of 1998 concerning Position Regulations for Land Deed Making Officials (hereinafter referred to as PPAT) are public officials who are authorized to make authentic deeds regarding certain legal actions regarding land rights or property rights Top of the Flats Unit. As a public official, PPAT is given the task and authority to assist the head of the Land Office in carrying out land registration such as making a Sale and Purchase Deed (hereinafter referred to as AJB). In the Judicial Review Decision Number: 909 PK/Pdt/2020 dated December 16, 2020, AJB has sued based on the power of attorney in the Sale and Purchase Binding Deed (PPJB). In his lawsuit, the seller has a wife, but in the proof, the Identity Card (KTP) is not married and the Family Card (KK) is alone. As PPAT, he is responsible for formally checking the file requirements, but PPAT does not have the obligation to check the correctness of materials such as Identity Cards (KTP). The transfer of the Buyer's land rights is in accordance with Article 19 paragraph (1) in conjunction with paragraph (2) letter c in conjunction with Article 37 paragraph (1) Government Regulation Number 24 of 1997 concerning Land Registration is strong evidence of the abolition of property rights and the legality of the transfer of land and carried out in accordance with the buying and selling procedure. Therefore, the author is interested in reviewing this problem to find out how PPAT is responsible for making a Sale and Purchase Deed (AJB) for the transfer of land rights to the buyer and how the power of the Sale and Purchase Deed (AJB) is as proof of payment of a legal transfer of land rights to the buyer. Buyer. In conducting this research, the research method used by the author is a qualitative research with a normative juridical type of research. The approach used in this research is a statutory approach, a case approach and a conceptual approach.
